Minimum Qualifications REACHABLE FOR APPOINTMENT FROM THE CIVIL SERVICE ELIGIBLE LIST FOR SENIOR ATTORNEY (ELIGIBLES’ PROFILE MUST MATCH THAT OF POSITION) OR ONE YEAR OF PERMANENT OR CONTINGENT PERMANENT SERVICE AS A SENIOR ATTORNEY OR ELIGIBLE FOR TRANSFER.
Duties Description The Senior Attorney in the Civil Recoveries Bureau (CRB) will be responsible for: reviewing and signing of Student Recoveries Unit papers and pleadings; coordination of bureau judgment enforcement; and review of bureau procedures, staff compliance therewith, and monitoring the effects of new and developing laws and legal theories on bureau practice. Duties include, but are not limited to:
• Review and sign legal papers, such as summonses with notice, complaints, stipulations, and judgments.
• Draft procedural motions relating to service of process, applications to open default judgments, and summary judgment.
• Review affidavits and memorandums of law drafted by student recoveries unit legal assistants and consult with the section chief on motion strategy.
• Prepare and filing income executions, information subpoenas, restraining notices, and other elements of CPLR Article 52 judgment enforcement on behalf of the several Albany based units.
• Work in conjunction with, advise, and supervise staff engaged in judgment enforcement on behalf of their respective units.
• Communicate procedures to the bureau’s attorneys and staff to ensure compliance with internal administrative policies and goals, such as confidentiality and appropriate use of OAG resources.
• Review procedures for all 10 CRB units, and advise bureau managers on the effectiveness thereof, degrees of compliance therewith, and strategies to improve bureau operations to eliminate or reduce elements of “risk” inherent in bureau operations.
• Analyze and summarize cases and information pertinent to constitutional provisions, statutes, rules, regulations, and policies and opinions, plans.
• Discuss proposed and new legislation with bureau personnel and legislative staff.
• Research requests and inquiries from Bureau managers and prepare legal memoranda.
• Interpret pertinent laws, rules, regulations, procedures, etc. impacting the practice of the CRB.
• Recommend changes in bureau practices and procedures based on evolving statutes and caselaw.
• Perform other duties as assigned.
