Job Specifics

Duties Description Responsible for supervision of the New York State Justice Center for Protection of People with Special Needs (Justice Center) Office of General Counsel’s Criminal Background Check Unit (CBC Unit). Management and oversight of CBC Unit that is comprised of attorneys, legal support staff, and administrative staff. Review and analyze statutory provisions in New York State law and regulations promulgated by the Justice Center. Duties include:

• Creation and supervision of the CBC Unit’s processes and policies to ensure that statutorily required criminal background checks are completed in a timely and legally sufficient manner;

• Ensure that the CBC Unit’s policies and procedures are compliant with New York State and federal laws governing the review and dissemination of criminal history record information;

• Supervision and training of CBC Unit staff. Responsible for training legal and administrative staff to ensure that agency protocols are maintained at all time;

• Providing legal advice and counsel on Criminal Background Check matters, including guidance to the field;

• Responsible for creation and presentation of training materials to state oversight agencies and providers of service;

• Providing legal analysis in areas which are expected to have a major impact on the mission and programs of the Justice Center. They will analyze state, local, and federal laws and prepare legal memoranda to assist senior administrators of Justice Center in matters before the State Legislature and local governments;

• Assisting the Justice Center General Counsel in representing the agency in different forums which may include other state or local agencies, private individuals and provider representatives;

• Oversee the maintenance and enhancement of agency resources, including the Criminal Background Check System (CBC System); and

• Coordinate agency access to eJustice system and ensure adherence to all audit and compliance requirements.

Minimum Qualifications Possess a Juris Doctor and admission to the New York State Bar for a period of at least eight (8) years, including at least four years of relevant employment experience in administrative law. Candidate must have at least five years supervisory experience, including supervision of attorney(s) and legal support staff.

Preferred qualifications include knowledge of public policy of NYS regarding employment and experience working with NYS, federal, and other state’s criminal statutes. Experience and knowledge of state and federal statutes governing pre-employment checks.
