Job Specifics
Duties Description Review member files in preparation for administrative hearings
o Review and acknowledge hearing requests and open appropriate hearing case
o Render assistance to applicants, attorneys and business partners
o Work professionally and cooperatively with co workers
o Compile medical records and indexes for medical cases
o Prepare and mail acknowledgement letters and scheduling forms
o Respond to emails and telephone calls
o Evaluate case to determine if an agency determination is issued or needed.
o Review case to determine whether the case should be returned for re-evaluation.
o Supervise and train legal assistant 1 in all aspects of hearing preparation
Coordinate and schedule all aspects of administrative hearings
o Track and monitor availability of hearing officers, court reporters and medical witnesses
o Render assistance to attorneys to establish exhibits needed for hearings
o Prepare and distribute hearing notices and proposed exhibits
o Handle confidential information in accordance with bureau and agency requirements concerning document classification and distribution
o Become proficient in Retirement and Social Security Law and other applicable statues, policies and procedures
o Collaborate and communicate with co-workers on all aspects of scheduling hearings
o Supervise and train legal assistant one in all aspects of scheduling hearings
o Schedule and track up to 150 cases annually
Finalize and Prepare Hearing Decisions for Publication
o Issue Brief due letters
o Issue Decision due letters
o Receive and upload incoming decisions and briefs and notify hearing officers of dates due
o Review draft decisions and communicate necessary edits to hearing officers prior to second level review
o Redact personal information from final determinations prior to public viewing

For appointment to a Legal Assistant 2, you must have:
Three years of full-time experience as a Paralegal/Legal Assistant (see “definition” below).
Definition: a Paralegal/Legal Assistant is someone who applies knowledge of the law and legal procedures in rendering direct assistance to lawyers, clients, and courts; prepares and interprets legal documents and forms; researches, compiles, and uses information from legal materials to provide both written and verbal comments on their findings; and analyzes and handles routine procedural problems independently with minimal attorney oversight.
Examples of non-qualifying experience: receptionist, records clerk, bookkeeper, office manager.
OR
An associate degree (or higher) in paralegal/legal assistant/legal studies program or a certificate in a paralegal/legal assistant program where the degree was granted from a regionally accredited college or university, or one approved by the American Bar Association (ABA) AND one year of experience as a Paralegal/Legal Assistant (see definition in MQs) OR an associate degree in any field where the degree was granted from a regionally accredited college or university, or one approved by the American Bar Association (ABA) AND two years of experience as a Paralegal/Legal Assistant (see definition in MQs) OR graduation from an accredited (ABA approved) law school with a degree required for NYS Bar will be accepted AND two years of full-time experience as a Paralegal/Legal Assistant (see definition in MQs).
Competitive Minimum Qualifications:
You must be currently reachable on the appropriate eligible list for this title, eligible under the 55 b/c program, or eligible to transfer to this title under Section 70.1 of the Civil Service Law.
For 70.1 transfer to a Legal Assistant 2, salary grade (SG)-17, you must have one year of permanent competitive, or 55-b/55-c service in an approved title for transfer allocated to an SG-15 or above.

Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade.

Additional Comments Knowledge, skills, and abilities:

Ability to conduct legal research, interpret and analyze agency determinations and review contracts

Telecommuting: The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks.
