Job Specifics
Duties Description The Public Campaign Finance Deputy Counsel will perform professional legal work in the analysis and interpretation of laws related to the work of the Public Campaign Finance Board within the New York State Board of Elections; including the review of candidate and committee filings to ensure regulatory compliance therewith, enforcement of the laws related to public campaign finance, and work with other agency counsels on other legal issues. Specific duties include:
• Assisting Counsel in providing legal services to the Public Campaign Finance Board.
• Providing legal advice, and assistance regarding the establishment of public campaign finance processes and procedures.
• Review any complaints made alleging a violation of public financing rules and regulations and investigate the same, ultimately making draft determinations of validity or invalidity that will ultimately be brought to the PCFB for action.
• Assist or personally prepare and present arguments at judicial and administrative proceedings, and draft findings, orders, or decisions.
• May present or try cases at proceedings by preparing opening statements and summations, arguing motions, examining witnesses, consulting with parties to the proceeding, examining evidence, preparing briefs, negotiating settlement, preparing appeals, and advising superiors.
• Recommend changes in or propose new agency rules, regulations, and policies and render legal advice and opinions on public campaign finance issues.
• Negotiate and prepare various legal documents such as contracts, deeds, and leases.
• Draft legal actions to enforce laws, rules, regulations, and policy
• Collect fees for services rendered by an agency, and review claims and approve payments, or recoup over-payments to candidate committee
• Engage in administrative enforcement activities and proceedings related to public campaign finance
• Act as a liaison with the Attorney General's office where the PCFB is a party in litigation.
• May supervise professional and support staff.
• Act as liaison between candidate representatives and attorneys outside the agency.
Minimum Qualifications Admission to the New York Bar and minimum of three years subsequent practice. (Experience in New York campaign finance law or prosecutorial experience a plus, but not necessarily required.)
