Job Specifics
Duties Description The Deputy Counsel reports directly to one of two Co-Counsels at the Board who is responsible for all legal matters at the State Board of Elections including ballot access and litigation in the state and federal courts by or against the State Board. The Counsels’ office oversees State Board contracts, responses to subpoenas and Freedom of Information requests, and the preparation of the State Board’s legislative agenda. The Counsel’s office is also responsible for supervision of the Campaign Finance Compliance Unit, statewide training seminars and webinars on campaign finance laws, and the State Board’s public information Call Center.
In general, the Deputy Counsel will work closely with the Counsel, the Co-Executive Director and Commissioners of the Board in developing, drafting and administering the New York State Election Law.
A candidate for Deputy Counsel must be an attorney who is familiar with the structure and function of the three branches (Executive, Legislative and Judicial) of New York State government and has some working knowledge of New York State Election Law, Village Law, Town Law, County Law, General Municipal Law, Municipal Home Rule Law and the Public Officers Law.
In addition to strong written and oral communication skills and a commitment to the democratic process, the candidate must possess specific legal skills and experience, such as:
* All aspects of litigation including legal research, drafting pleadings, motion practice, trials and appeals.
* The ability to analyze an issue and make recommendations to the Co-Counsel and the Board.
* The drafting of legislation, rules, regulations and formal and advisory opinions.
The Deputy Counsel is a resource for Election Law questions raised by the local boards of elections, public officials, candidates and the general public. In addition the Deputy Counsel, assists the Co-Counsel and the State Board’s Public Information Office regarding inquiries from the media.
Minimum Qualifications The prospective candidate shall possess a Law Degree (J.D.) from an accredited College or University, must be admitted to the New York State Bar, and must have at least a minimum of four years legal experience in either the public or private sectors.
