Job Specifics
Duties Description The Associate Attorney will provide a variety of legal advice to the NYS Thruway Authority (NYSTA) but will be primarily assigned to the Office of Real Property Management within the Legal Department. The incumbent will be expected to work closely with NYSTA employees, other New York State entities such as the Offices of the Attorney General, Comptroller, and NYSDOT, along with Federal Highway Administration (FHWA), and the general public in addressing disposals of surplus property rights, acquisition of property rights for NYSTA needs, transfers of jurisdiction, leases, and encroachments. Duties will include but not be limited to the following:
• Supervise real property staff and manage components of NYSTA real property program involving appraisals, acquisitions, and/or dispositions, control of right-of-way access, land-use, real property encroachments, leases, easements, and real property permits.
• Provide guidance and technical direction regarding policies, procedures, laws, rules and regulations related to NYSTA real property.
• Coordinate with other NYSTA departments (including but not limited to Media and Government Relations, Finance and Accounts, Maintenance and Operations, and Engineering) and NYSTA regional offices as well as other involved State, federal, local, private, and not-for-profit entities.
• Develop and implement operational policies, procedures, guidelines regarding real property program operation.
• Analyze legislative proposals related to real property.
• Conduct legal research, draft memoranda, and provide legal advice regarding procurements and contracts.
• Represent NYSTA in contract negotiations, debriefings, and vendor responsibility hearings.
• Negotiate, draft, and review legal documents including, but not limited to, requests for proposals, requests for qualifications, contracts, agreements, and memoranda of understanding between NYSTA and other State entities.
• Determine contractual obligations affecting NYSTA.
• Resolve various contract disputes.
• Respond to procurement protests.
• Analyze legislative proposals related to procurement.
• Provide counsel to NYSTA Departments including but not limited to Executive, Legal, Engineering, Maintenance and Operations on projects, including and not limited to, compliance with State and federal statutes and regulations, energy, bridges, service areas, cell towers, legislation, rulemakings, All-Electronic Tolling, occupancy and work permits, solar, climate change, transmission lines/poles, pipelines, electric vehicles, and salt contamination.
• Assist with review and preparation of testimony for disputes, hearings, and submittals regarding environmental issues and compliance with State and federal environmental laws and regulations.
• Provide counsel to NYSTA staff and consultants regarding compliance with environmental laws and regulations.
• Review environmental compliance issues where hazardous contamination is discovered.
• Review and analyze hazardous material management and removal regarding contract and lease requirements, change directives, change orders, relief requests and schedule claims.
• Draft language and provide counsel for NYSTA’s Individual MS4 Transportation Permit.
• Consult with DEC, DPS and DOT legal staff to review NYSTA compliance with State and federal environmental laws and regulations.
• Review and respond to SEQRA and NEPA environmental notices, applications and updates on NYSDPS Article VII and Article X matters.
• Review, analyze, and respond to notices for Statewide energy and environmental projects potentially impacting NYSTA.
• Additional duties as assigned by the General Counsel, Deputy Counsel, and/or Executive Staff.
Minimum Qualifications Current New York State employee with one year or more of qualifying permanent service allocated to a Grade 26 or above and eligible for transfer under Section 52.6 of the NYS Civil Service Law.
All candidates must be admitted to the New York State Bar and have a current Attorney Registration.

ADDITIONAL PAY INFORMATION:
The salary range for this position includes all applicable annual components of pay which are:
Starting Base Pay: $109,660
Recruitment & Retention Pay: $7,000
