Job Specifics
Duties Description The candidate will provide general legal advice and services to the Adirondack Park Agency (APA) in all program areas, with a focus on impact and policymaking projects. The candidate will perform a variety of duties, including, but not limited to, the following: drafts and reviews legal documents in support of APA’s regulatory, enforcement, planning, and local government services programs; represents and supports APA staff in meetings in support of APA’s regulatory, enforcement, planning, and local government services programs; drafts and reviews regulatory and legislative proposals; discusses and advises on proposed and new legislation with APA staff, legislators, and other state agencies; recommends, drafts, and reviews changes in APA rules, regulations, policy, and guidance to take into account new legislation, court decisions, and requested or needed changes; negotiates settlements in enforcement matters; represents APA staff in adjudicatory hearings and other proceedings on permitting and enforcement matters, including but not limited to the preparation of legal documents, preparing and examining APA witnesses, and conducting cross-examinations; assists the Attorney General’s Office in the prosecution and defense of civil actions brought by and against the APA; draft and review of contracts and other legal documents related to general administration of APA. The Associate Attorney may provide supervision and training at the Agency. The Associate Attorney is expected to demonstrate sound judgement and independent decision making as appropriate for the particular situation and provide a high level of review and support of the Agency’s work.
PREFERRED SPECIALIZED EXPERIENCE:
- the APA, Wetlands, and Rivers Acts and implementing regulations and case law, and a working knowledge of other statutory and regulatory requirements, including ECL, SEQR, Town Law, and Executive Orders relevant to administration of the APA;
- Familiarity with NYS FOIL, SAPA, and POL;
- Familiarity with NYS regulatory and legislative proposal process;
- Legal experience in a General Counsel’s office at a local, state, or federal government agency;
- Litigation experience, preferably in administrative law and New York state civil
procedure;

Minimum Qualifications Candidates must be reachable on the appropriate Civil Service eligible list. Qualifying Experience for appointment from the eligible list: After two years of service as a Senior Attorney and/or Senior Attorney (Various Parenthetics), successful candidates will be qualified for appointment from the eligible list.
OR
Candidates must have one year of permanent competitive or non-competitive 55 b/c service as an Associate Attorney or be eligible to transfer under section 52.6 of the Civil Service Law.
OR
Non-Competitive Promotion Qualification:
If the number of eligible interested candidates is three or less, the agency, at its discretion, may nominate a candidate for a non-competitive promotion under the provisions of Section 52.7 of the Civil Service Law. If approved by Civil Service, this would be considered a permanent appointment.
In order to be eligible for an NCP, candidates must be an employee of the Adirondack Park Agency (APA) and have two years of permanent competitive or 55-b/55-c service as a Senior Attorney.

Provisional Qualifications:
Must be a qualified employee of New York State and have had two years of permanent competitive or 55-b/55-c service as a Senior Attorney.
If appointed provisionally, the incumbent will need to take the next Civil Service examination for this title and pass with a score that will be immediately reachable on the resulting eligible list. Failure to take, pass and achieve a reachable score on the examination may result in revocation of the appointment.
Additional Comments Salary Grade: SG-28. The starting salary for this position is $112,528.00. The salary range is $112,528.00 to $138,203.00.
For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
