Job Specifics
Duties Description Under the general direction of the Executive Director, the Equal Opportunity Specialist 3 will serve as the designated diversity and inclusion officer, directing the agency’s Diversity, Equity, Inclusion, and Accessibility programs.
Specific duties include, but are not limited to:
• Plan, develop, and monitor the agency’s DEIA plan and programs, including periodic reviews and revisions to guidelines, manuals, procedures, etc.
• Manage and oversee the implementation and continued maintenance of the Diversity and Inclusion Plan and make recommendations on improvements.
• Ensure the consistent application of the Americans with Disabilities Act, the New York State Human Rights Law, the Equal Employment Opportunity in New York State – Rights and Responsibilities Handbook for Employees of New York State Agencies, Procedures for Implementing Reasonable Accommodations for Applicants and Employees with Disabilities and Pregnancy Related Conditions in New York State Agencies, Procedures for Implementing Reasonable Accommodations of Religious Observance and Practice for Applicants and Employees, and Procedures for Implementing Reasonable Accommodations in Program and Services for Individuals with Disabilities.
• Prepare periodic reports of program activities for the agency and for regulatory agencies and develop and review reporting formats and guidelines for the programs.
• Interpret federal and State laws, rules, and regulations, as well as State and agency policies to ensure compliance.
• Provide DEIA guidance to outreach and recruiting activities in collaboration with Human Resources.
• Oversee the administration of the reasonable accommodation program, religious accommodation program, and adaptive equipment requests, in accordance with all applicable federal and State laws, rules, and regulations.
• Oversees the review of personnel actions such as hiring, promotion, and termination to ensure fairness and equity.
• Coordinate the acquisition of data and information related to DEIA activities.
• Collaborate with agency staff in the review of MWBE requirements for and reporting by regulated parties.
• Represent the agency at events on diversity, inclusion and equal opportunity. Also represents the agency in various committees and councils with DEIA peers on workforce related matters.
• Conduct and guide training related to equal opportunity issues related to employment and the provision of services, reasonable accommodations, religious accommodations, and the culturally, ethnically, linguistically, and spiritually appropriate delivery of services.
• Promote an inclusive, respectful, and equitable work environment by assessing organizational culture and barriers to diversity and planning and implementing initiatives to create positive organizational changes conducive to diversity, which includes surveying staff, analysis of data, and overseeing the planning of agency sponsored or other cultural events.
• Perform other duties necessary to advance the State’s and agency’s DEIA initiatives.
• Perform the full range of supervisory duties.
Minimum Qualifications Non-Competitive: Eight years of experience in equal opportunity, diversity and inclusion, or human rights. At least one year of the experience must have been at a supervisory level; OR one year of State service in an equal opportunity, diversity and inclusion, minority business, employment compliance, human resources, or training position allocated at or above Grade 23.
Qualifying experience includes working with organizations concerned with equal opportunity, diversity and inclusion, civil rights, minority business development, or similar programs; or in recruiting, training, and upgrading the educational and job qualifications of protected class members.
Substitutions: An associate’s degree may substitute for two years of the non-supervisory experience; bachelor’s degree for four years; and J.D. or master’s degree for five years.
Additional Comments NOTE ON TELECOMMUTING: Gaming Commission employees are required to apply and obtain approval through management to telecommute according to the Gaming Commission’s Telecommuting Program Guidelines.
Prohibition against Playing and Wagering:
Commission employees and family members residing in their households are prohibited from purchasing Lottery tickets or claiming Lottery prizes. Commission employees are prohibited from wagering upon any horse racing, commercial gaming, video lottery gaming, Indian gaming, charitable gaming activities, interactive fantasy sports, and mobile sports wagering within the State. To avoid any appearance of impropriety of conflict of interest, Commission employees will be prohibited from all aspects of promoting, operating, and playing in any charitable gaming, which includes bingo and games of chance such as raffles, whether the organization conducting the game is required to be licensed by the Commission. The prohibition placed upon each Commission employee from assisting with any charitable gaming does not apply to the employee's family unless the employee thinks it presents a conflict of interest related to his or her job duties. Commission employees must also avoid any outside activities that could interfere or be perceived to interfere with their job duties.
