Job Specifics
Duties Description The Assistant Counsel, NS-27, in the Litigation section of the Office of General Counsel (OGC) applies demonstrated abilities and experience beyond entry-level with increasing responsibility and complexity of work, commensurate with achievement and aptitude in litigation matters related to compliance with the Public Service Law, Commission regulations, and orders. Under the direction of supervising attorneys, duties would include but are not limited to:
• Representing the Commission and the Department in Civil Practice Laws and Rules Article 78 proceedings seeking review of agency determinations in trial and appellate courts.
• Appearing for and on behalf of the Commission and the People of the State of New York (utility consumers) in administrative and legal proceedings pertaining to electric, natural gas, water, and telephone services before various State and/or Federal regulatory agencies.
• Bringing judicial actions before the courts of New York when appropriate.
• Conducting research and preparing memoranda on legal issues related to actions of the Commission, including, without limitation, consumer protection matters.
• Taking responsibility for drafting clear, accurate, and persuasive written documents and providing clear oral advocacy, presentations, and briefings.
• Recommending changes to or proposing new Department rules, regulations, and policies.
• Providing legal advice to other divisions within the Department.
• Undertaking legal and related research based on requests made by individual Commission members.
Minimum Qualifications Candidates must have a law degree, be admitted to the New York State Bar, and have a minimum of three years of progressively responsible post-bar experience as an attorney in litigation, where they have analyzed legal issues, researched and interpreted complex areas of law, and drafted and submitted litigation documents synthesizing law and facts.
Clear and effective writing and oral communication skills are essential requirements. Knowledge of the Public Service Law or experience in utility or other public sector regulation is preferred. Additional experience in regulatory law, economics, engineering, accounting, consumer protection, trials or hearings, or judicial clerkships can strengthen an application.

Remarks:
Salary will be commensurate with experience. The primary location for this position is either Albany, NY, or New York, NY. If the position is filled in the New York City location, the salary range above would increase by the Downstate Adjustment of $4,000. This position requires at least 10% travel which requires possession of a valid driver’s license. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Appointment to this position is contingent upon Division of Budget approval.
