Job Specifics
Duties Description The Senior Attorney will advise and counsel the Commission of Correction, the Correction Medical Review Board and the Citizen’s Policy and Complaint Review Council (CPCRC). In addition, the incumbent of this position will be responsible for the following critical agency functions:
• Direct, advise, and counsel Commission investigators relative to correctional facility audits and investigations of incarcerated deaths and other incidents
• Draft and promulgate compulsory regulations for state, county, and municipal correctional facilities, coordinate regulatory reform
• Review jail grievance appeals and coordinate the CPCRC’s system of review and response
• Construct and draft agency legislative proposals
• Provide legal guidance and advisory opinions for correctional facility administrators and other public officials
• Prepare and litigate mandamus and prohibition proceedings in New York State Supreme Court to enforce agency regulations and jurisdiction
• Serve as litigation liaison to the Office of the Attorney General
• Orchestrate the agency’s system of responding to Freedom of Information Law (FOIL) requests, including the identification of privileged records and the litigation of subsequent requestor appeals
• Coordinate the Commission’s Juvenile Justice and Delinquency Prevention Act compliance monitoring activities and act as liaison with the Division of Criminal Justice Services and the Office of Juvenile Justice and Delinquency Prevention
• Approximately 5% travel is required
Minimum Qualifications NON-COMPETITIVE MINIMUM QUALIFICATIONS:
Admission to the NYS bar and two years of post-licensure professional legal experience.
NY HELPS: This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).
For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply.
At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
COMPETITIVE MINIMUM QUALIFICATIONS:
Permanent service in this title or one year of permanent competitive or 55b/c service in a title SG-23 or higher and otherwise eligible for transfer under Civil Service Law.
Additional Comments This position may require up to 5% travel to locations not serviced by public transportation.
