Job Specifics

Duties Description Under the direction and guidance of senior level Labor Relations staff and the Human Resources Director, the candidate for this position will support the Labor Relations office.

Duties include, but are not limited to:

• Advise managers and staff in the application of all applicable collective bargaining agreement (“contract”) provisions, agency and state policies and procedures, and any labor relations applicable laws or rules that govern or impact Division staff.

• Advise supervisors and managers in troubleshooting employee related performance and/or behavior issues, providing guidance to appropriate corrective mechanisms.

• Investigate allegations of performance or behavior related misconduct, to include performance of interviews, interrogations, document review, etc. Ensure allegations of discrimination are properly routed to OER Anti-Discrimination Investigation Division (ADID).

• Draft summary of investigative efforts for Human Resources Director and program management where applicable.

• Implement the contractual mechanisms for employee discipline where appropriate. Draft Notices of Discipline with appropriate detail and accuracy, discuss settlement options with management, prepare cases for hearing, prepare witnesses for testimony, and serve as DHSES advocate at assigned disciplinary arbitration hearings.

• Provide guidance on alternative mechanisms to address employee performance and/or behavior including counseling and coaching.

• Administer and implement all aspects of the employee grievance process including education and assistance to program management at Step 1, meetings and response at the agency/Step 2 level on behalf of DHSES, and liaison with OER for grievances which progress to Steps 3 and 4.

• Conduct live and remote training presentations.

• Participate in DHSES local and statewide Labor/Management Committee meetings and conduct follow up review to resolve issues.

• Serve as liaison to the Governor's Office of Employee Relations and other control agencies in the resolution of labor relations issues, ensuring timely and accurate response.

• Conduct investigation and provide representation as necessary in response to Improper Practice charges, Employee Health Services referrals, Unemployment Insurance claims, etc.

• Perform the full range of supervisory responsibilities, including training and professional development efforts, for any subordinate Labor Relations staff assigned.

• Complete other duties and special projects as assigned.

Minimum Qualifications TRANSFER

Current New York State employee with one year or more of permanent, contingent-permanent, or 55b/c service in a position for transfer under Section 52.6 as appropriate of the Civil Service Law.
