Job Specifics

Duties Description The Associate Attorney will review the criminal histories of applicants for employment in nursing homes, home health care, adult care facilities, health homes and hospice, and rendering legal employability determinations after allowing applicants an opportunity to explain their criminal history. Specific duties include:
Review and analyze files for accuracy and completeness and render employment eligibility decisions.
Interpret pertinent laws, rules, regulations, and procedures and are responsible for additional projects as assigned by the CHRC Legal Bureau Director/Principal Attorney.
Assist in the training and orientation of new and/or junior CHRC Legal Bureau attorney staff.
Participate in and/or are assigned as appropriate, legislative drafting and opinions with respect to proposed legislation, Bill Comments and applicable regulatory amendments.

Minimum Qualifications Current New York State Department of Health employee with permanent or contingent-permanent status as an Associate Attorney, SG-28, OR; Current New York State employee with one year or more of permanent or contingent-permanent competitive service in a title at SG-26 or above, with current NYS Bar Admission, and eligible for transfer to Associate Attorney under Section 52.6 of the Civil Service Law.

Preferred Qualifications: Highly motivated individual interested in working in an active, investigative/legal team environment.
Demonstrated good decision-making, oral and written communication skills.
Ability to handle high volume activities in a dead-line driven environment.
Thorough knowledge of the NYS Correction Law, Executive Law, Criminal Procedure Law, Penal Law and familiarity with the criminal justice/penal system.
Given the anticipated volume, pace and diversity of issues/tasks tackled daily, the ideal candidate would also be self-propelled, detail-oriented and possess consistent follow-through.
