Job Specifics

Duties Description Under the general supervision of the Deputy Commissioner and General Counsel of the Office of General Services, the incumbent of this position will provide legal counsel and assistance to the agency’s executive staff and business unit administrators for real property leasing transactions and assume responsibility for legal services in support of the extensive and diverse OGS functions and associated supervisory functions concerning the OGS centralized space leasing program and special projects relating to property management and land utilization. The incumbent will also be the OGS Ethics Officer and have the associated duties of that position.

Duties include, but are not limited to:
• Provides legal evaluations, oversight and advice relative to the OGS centralized space leasing program under the Public Buildings Law, which addresses over 600 active leases, comprising on an annual basis preparation of approximately 100 leases, supplemental and associated contracts, with legal guidance provided to the Division of Real Estate, Leasing Services staff in the preparation, revision, and processing for approvals of State leases.
• Participate in the formulation, negotiation, and preparation of complex and comprehensive leases and related financing, mortgages, and associated instruments for major facility construction or conversion contracts including legislation, contracts, bonds and real property management.
• Drafts analysis for and approves lease contracts and pertinent standard and special lease clauses as required. Specifically, prepares lease clauses and documentation requiring particular individual attention and expertise in the metropolitan New York City area.
• Provides counsel on the administration of contract for brokerage services to meet the ongoing leasing requirements for the OGS centralized space leasing program.
• Provides counsel to pertinent OGS executive staff and business unit staff on legal issues, definitions, and framework for their mission relating to space needs, and the procurement and contract needs including transitional, first-time and long-term projects related to those projects. Formulates process improvements to effectively address evolving legal environment and movement in various marketplaces.
• Participates in initiatives relating to major facility construction, developer projects and critically required rehabilitation programs of existing facilities involving long-term, complex real property and construction related transactions.
• Provides counsel and renders opinions to the agency’s executive and policy-making officers addressing the extensive program of leasing space in the Governor Nelson A. Rockefeller Empire State Plaza and other OGS-operated office buildings statewide for office space, retail stores and private sector services, the leasing of associated parking areas and issuance of concessions to private operators of such spaces and facilities. Provides counsel and renders opinions to the agency’s executive and policy-making officers and other departmental executives and attorneys on subleasing and licensing of space in order to utilize otherwise unused space.
• Evaluates and develops causes of actions and defenses to claims, actions and proceedings relating to litigation involving OGS leased spaces. Assembles all evidentiary materials for respective litigations.
• Represents and acts as advocate for the agency in interactions with the Division of Budget, Office of the Attorney General, Office of the State Comptroller, and other State agency attorneys. Participates in negotiations and extensive communications with representatives of landlords, developers, contractors, and a wide range of private sector and governmental entities.
• Acts as the agency’s Ethics Officer. Interprets applicable law, regulations, and guidelines, renders assistance and formal agency opinions in relation to ethical requirements for OGS employees. Responds to questions from OGS staff regarding ethical requirements. Develops and provides ethics training to OGS staff. Reviews and approves travel requests and requests regarding outside employment.
• Acts as an advocate and subject matter expert in agency representation for procurement lobbying matters internally and externally. Advises agency staff on implementation of procurement lobbying requirements and potential policy and process changes and improvements in management relative to procurement lobbying and contracts and other related matters. Works with other governmental entities and other affected parties (such as the business community) on the interpretation and application of procurement lobbying restrictions. Prepares and provides training to OGS and other governmental entities relative to scope of procurement lobbying law and its implementation. Develops and implements internal agency policies related to procurement lobbying.
• Supervise professional staff including a senior attorney.
• Assists Deputy Counsel & Legislative Counsel in preparation of OGS legislative program by providing evaluations, comments, and recommendations on legislative proposals developed by the agency or by other agencies in relevant subject areas.

Minimum Qualifications Current New York State employee with one year or more of qualifying permanent service in a position allocated to a Grade 26 or above and eligible for transfer under Section 52.6 of the Civil Service Law.

Additional Comments • Travel may be required (approximately 5%)
• One day of telecommuting after three months and two days allowed to telecommute after six months.
