Job Specifics

Minimum Qualifications To be considered for permanent appointment, candidates must be reachable on the current Civil Service eligible list or be eligible for reassignment or transfer in accordance with Civil Service Law.

Duties Description The Hearing Officer shall be assigned to the Division of Legal Affairs, Office of Proceedings.

These duties may include, but may not be limited to:

• Preside at quasi-judicial or administrative hearings regarding the regulation of motor carriers, oversize-overweight vehicles on state highways, railroad crossings, contract audit appeals, or other transportation subject matters as necessary.
• Conduct hearings, which may require administering oaths and affirmations, issuing subpoenas, evaluating evidence, ruling on objections, managing the official record, and making findings of fact and conclusions of law.
• Rendering or recommending written decisions, which may require researching court cases, legal interpretations and citations which are pertinent to the issue.
• Assess current policies and procedures to recommend and implement improvements.on of motor carriers, oversize-overweight vehicles on state highways, railroad crossings, contract audit appeals, or other subject matters as necessary.
• Conduct hearings, which may require administering oaths and affirmations, issuing subpoenas, evaluating evidence, ruling on objections, managing the official record, and making findings of fact and conclusions of law.
• Render or recommend written decisions, which may require researching court cases, legal interpretations and citations which are pertinent to the issue.
• Provide other general legal analysis, advice and assistance to Department personnel and communicate with outside entities on behalf of the Department as may be needed.

Topics to be handled, include issues involving Transportation Law, Highway Law, Vehicle and Traffic Law, Public Officers Law, Finance Law, Executive Law, highway construction and maintenance, Federal Highway Administration, traffic safety, insurance, highway beautification and environmental matters.
