Job Specifics

Minimum Qualifications One year of permanent competitive service as a Senior Attorney; or one year of permanent competitive service in a title eligible to transfer under Section 52.6 or 70.1 of the Civil Service Law with current New York State Bar Admission; or be reachable on the Legal Specialties eligible list. Candidates that have less than 24 months of experience must serve a traineeship with advances at 1-year intervals until eligible for appointment at the Senior Attorney level.

Duties Description The NYS Department of State is seeking a highly motivated consumer protection attorney to assist the Utility Intervention Unit (UIU) in representing the interests of consumers in utility rate and policy cases and other regulatory proceedings before the New York Public Service Commission (PSC), Federal Energy Regulatory Commission (FERC), the New York Independent Systems Operator (NYISO), and other forums with jurisdiction over New York public utilities. The attorney will advocate on behalf of UIU for reliable utility service at the lowest reasonable cost, with a particular emphasis on the interests of residential and small business customers. The attorney will serve in the General Counsel’s office as counsel to UIU and will report to the UIU Lead Counsel. Candidates should have a broad knowledge of the law and policy issues related to the telecommunications, water, electric, natural gas industries, and climate change goals of New York State. Responsibilities include:

• Draft legal memoranda and comments, advocating UIU’s positions in rate, policy, and other proceedings.
• Conduct discovery, participate in confidential settlement negotiations and administrative hearings (including cross examination), and assist experts in preparation and filing of testimony.
• Represent and advocate for UIU’s position in meetings and collaborative proceedings.
• Observe utmost sensitivity to confidentiality requirements.
• Provide analysis and recommendations on proposed legislation.
• Assist in preparation of vendor contracting for expert services.
• Other internal legal administrative tasks.

This is a writing-intensive position in a collegial environment that requires an aptitude for understanding and communicating complex technical and mathematical issues such as transmission infrastructure and utility rate design and may periodically include non-overnight travel and longer hours to meet deadlines.
