Job Specifics

Minimum Qualifications Admittance to the New York State Bar and five years of post-bar legal experience in administrative, environmental, or energy law.

NOTE: Candidates must be law school graduates who are admitted to the New York State Bar and whose membership is in good standing. Please be sure to include in your resume or cover letter the specific Civil Service title which qualifies you for transfer under Section 52.6 of the Civil Service Law.



Preferred Qualifications

Broad array of environmental/regulatory law experience, including experience with administrative hearings or litigation, analyzing legal issues, and researching and interpreting complex areas of law; experience in the energy and environmental sectors, and more specifically with New York’s electric industry and/or renewable energy field, clean energy siting, or in siting of major transmission and/or generation projects under the State Environmental Quality Review Act, Public Service Law (PSL) Article VII and/or PSL Article 10; and strong oral and written communication skills.



Duties Description Reporting to the Hearing Examiner serving as Chief Administrative Law Judge, Hearing Examiners conduct administrative adjudicatory and public comment hearings and are responsible for the factual and legal review of applications for siting permits under section 94-c of the Executive Law and other statues administered by the Office of Renewable Energy Siting (ORES). The incumbents will perform duties that include, but are not limited to, the following:

• Establish procedural milestones and schedules; issue written rulings on process issues, including schedule, discovery, party status and other disputes among parties; finalize and ensure the legal sufficiency of legal notices for publication; and conduct pre-hearing conferences, public comment hearings, and issues determination procedures.

• Oversee the development of the official case record through a formal, litigated quasi-judicial adjudicatory process; administer oaths; issue subpoenas, as needed; rule on admissibility of evidence; interrogate witnesses whenever required; structure hearing presentations, and maintain order, decorum and efficiency as a court of record.

• Research the record, briefs and the law to analyze complex scientific, technical and legal matters; evaluate evidence, including expert scientific and technical evidence and testimony; make findings of fact and conclusions of law; render or recommend decisions; prepare comprehensive reports including recommended decisions.

• Upon conclusion of administrative proceedings, draft final decisions binding the agency for the Executive Director’s signature.

• Keep current on rules and regulations, changes in law, administrative directives, etc.

• Perform other tasks as assigned.


Additional Comments ORES will be instrumental in helping New York State meet the Climate Leadership and Community Protection Act (CLCPA) policy goals, the most ambitious climate legislation in the United States. The office will be responsible for implementing and executing a new streamlined permitting process for renewable energy projects in New York State greater than 25 MW, and any projects 20 MW and above that opt into the siting process administered by ORES. The process has been streamlined within this new office to decrease the time from application to approval for construction to a maximum of one year.

Positions will be located in Albany and White Plains.
