Minimum Qualifications Candidate must be reachable on the interdepartmental list for Associate Attorney, or be a current New York State employee with one year of permanent competitive or non-competitive 55-bc service as an Associate Attorney or be in a title deemed eligible for transfer under Section 70.1 or 52.6 of the Civil Service Law. Candidate must be admitted to the New York State Bar.

Duties Description The Associate Attorney will provide legal assistance and support of OMIG Medicaid program integrity activities related to both policymaking and litigating issues that may arise in administrative forums and the courts. Cases and legal issues may involve complex or novel matters for which there is little precedent and/or which have a major impact on the OMIG’s mission and program. The Associate Attorney may serve as a legal advisor to OMIG Division managers as well as supervise and/or direct the work of Senior Attorneys, Legal Assistants, and other administrative/clerical support staff in the Office of Counsel. The incumbent may perform work related to Managed Care, Medicaid financing, Collections and Bankruptcy issues, NYS Budget proposals and processes, and legislative and regulatory initiatives. The incumbent is expected to read and analyze statutes, rules and regulations and draft legal opinions, memoranda of law, briefs and other materials, and negotiate or settle matters on behalf of the OMIG.

Reporting to the General Counsel (and/or Deputy Counsel), the Associate Attorney’s job duties include, but are not limited to assisting with all aspects of the legal work assigned to the Office of Counsel and day-to-day management of staff and work activities. This includes reviewing the work of Senior Attorneys and Legal Assistants and providing training and instructions, handling high priority assignments from the General Counsel, and agency executive staff, collaborating on programmatic issues and evaluating the impact of changes in laws, rules, and regulations to the Medicaid program and policy interpretation and/or legal analysis to support agency determinations that may involve administrative hearing presentation and/or court litigation. The Associate Attorney will also manage and assist with all aspects of litigation (requesting representation, reviewing the petition/complaint, preparing response papers, affidavits, and memoranda of law, preparing litigation hold documents and managing e-discovery and the litigation hold process, conducting legal research, engaging in motion practice, etc.), as well as general case and project management. This may include reviewing and triaging incoming litigation, handling, or assigning cases as appropriate and providing training and guidance to Office of Counsel staff on all aspects of litigation. Travel is required as part of this position.

Additional Comments There will be an additional $3026 for downstate adjustment.
