Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.1, 70.4, or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration.)
Preferred Qualifications: The preferred candidate must have strong legal skills, be able to work as a member of a team, have demonstrated good decision-making skills, possess excellent oral and written communication skills, and must have the ability to handle high-volume activities in a dead-line driven environment. The ability to organize and prioritize a high volume of tasks is critical. The preferred candidate should be a highly motivated individual interested in working in an active legal team environment and have experience in courts or administrative hearings involving contested public health issues.
Duties Description This position is assigned to the Bureau of Litigation in the Department of Health’s Division of Legal Affairs, which deals with areas of law such as epidemiological matters (COVID-19), communicable diseases, Medicaid rate setting, Medicaid eligibility determinations, managed care, health care reform, health facility licensure, surveillance, and regulation, environmental health and hazards, hazardous wastes, sanitary code, vital records, bankruptcy, collections, funeral director and cemetery, social services, mental health, developmental disabilities, enforcement actions and administrative determinations, patient abuse, NYS owned and operated Veterans’ Homes and Helen Hayes Hospital, and matters related to the Wadsworth Laboratory. The incumbent will act as a liaison with the Office of the Attorney General (“OAG”), Executive Chamber, and DOH’s staff in the defense and prosecution of lawsuits which involve the Department in a high-volume deadline driven environment; handle cases involving any area or subject matter that DOH regulates, oversees, or has any involvement in and assist the State in any litigation DOH is not a party to; review legal papers, including subpoenas and levies, served or received to determine appropriate responsive action; prepare DOH employees for depositions or testimony; interface with other Federal and State government agencies seeking DOH documents, testimony, or information and the appropriate DOH staff; advise program(s) of litigation commenced and developments in existing litigation and determining agency position on issues raised in legal papers; convey agency position and legal precedents to the OAG and develop with the OAG the agency’s legal position; preparing affidavits, briefs and other papers for use in litigation; review requests for legal action received from Programs to determine appropriateness, preparing referral letters to the OAG, and develop the Agency’s case; prepare memoranda to executive staff and program(s) advising them of developments in litigation, the ramifications of court orders and decisions and responding to requests from program(s) for opinions and information concerning litigated matters; and maintain and update multiple tracking, calendaring, and filing systems.
