Minimum Qualifications MINIMUM QUALIFICATIONS:

Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and four years of relevant post-bar experience.

Duties Description STANDARD DUTIES:

The Associate Counsel presents cases to the Board at Board meetings, presides in proceedings as a hearing officer, and drafts, reviews and edits decisions. The Associate Counsel also stays current and advises as needed on developments in federal and state court cases. The Associate Counsel will:

Conduct pre-hearing conferences
• Provide fair and impartial conferences.
• Conduct informed discussion of cases.
• Explain IBA procedure to the parties.
• Accurately answer questions relating to the IBA procedure.
Conduct Hearings
• Serve as fair and impartial hearing officer.
• Display appropriate judicial temperament.
• Rule on motions when permitted.
• Ensure clarity of record and orderliness of proceedings.
• Exercise appropriate discretion.
Draft and edit Board decisions
• Timely draft decisions, as assigned, for the Board’s consideration that reflect logical and legal reasoning written in a clear and well-organized fashion.
• Appropriately cite statutes, regulations, case law and other legal authority in drafting or editing of decisions.
• Review for editing decisions drafted by other staff, as assigned.
• Prepare summary of Board decisions to be posted on Board website, as assigned.
Provide legal advice
• Research general issues of law for the IBA in a thorough, accurate and timely manner.
• Provide information and guidance on researched issues.
• Provide well-reasoned written legal guidance to the Chairperson as requested.
Assist in other functions as necessary
• Support other IBA activities as necessary.
• Conduct case management conferences as needed.
• Assist the Counsel, Deputy Counsel, or IBA Chairperson with any requests.
