Minimum Qualifications MINIMUM QUALIFICATIONS:

Reassignment: Candidates must have one year of permanent competitive or 55b/c service as an Associate Attorney.

Eligible List Appointment: Candidates must be reachable on the Civil Service eligible list for Associate Attorney. If you are on the Civil Service eligible list for this title, you may receive a canvass letter. You must complete and return it as instructed on the letter.

Section 52.6 Transfer: Candidates must have one year of permanent competitive or 55b/c service in a title SG-26 or above deemed eligible for transfer under Section 52.6 of the Civil Service Law AND possess a Juris Doctorate degree AND be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity. Duties Description The New York State Education Department’s (NYSED) is seeking candidates for an Associate Attorney position in the Office of Counsel. Duties of this position include, but are not limited to, the following:

• Perform special assignments as requested by the Counsel or management team;
• Supervise senior attorneys, make and review legal assignments, and provide or direct appropriate training;
• Direct subordinate staff in the preparation of technically complex, precedent setting, or other higher level casework;
• Assist in the determination of assignment priorities in accordance with organizational needs or timetables;
• Provide legal advice and counsel, and assist in the drafting and review of NYSED guidance;
• Perform research, draft proposed decisions in appeals of actions or decisions of local school district officials brought to the Commissioner for resolution under Education Law §306 and §310 and other related appeal processes, including Freedom of Information Law (FOIL) appeals, and assist in the review of such proposed decisions;
• Provide legal advice and counsel on issues related to the responsibilities of one or more of the Department’s Program Offices, contracts, memoranda of understanding and other agreements, fiscal issues, and/or the chartering and consent process for not-for-profit education corporations;
• Provide assistance to the Attorney General (AG) in litigation handled by the AG, and provide effective representation in litigation and administrative proceedings handled by the NYSED’s Office of Counsel;
• Respond to and/or coordinate responses to subpoenas;
• Review and prepare recommendations on complex legislative proposals developed both within and outside of the NYSED;
• Perform a variety of legal services, including legal research, preparing legal briefs, negotiating and preparing legal documents and similar functions;
• Participate on assigned Office of Counsel functional work teams; and
• Supervise and delegate tasks to administrative staff.


Additional Comments CONDITIONS OF EMPLOYMENT: This will be a contingent-permanent appointment. For 55b/c appointment, candidates must possess the minimum qualifications, a current 55b/c eligibility letter and is subject to verification of applicant eligibility. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree, Bar admission and work experience will be required for all candidates at the time of interview. Candidates are required to possess and maintain admission to the New York State Bar. Failure to maintain an active registration to the New York State Bar will result in removal from employment.
