Minimum Qualifications REACHABLE ON THE DEPARTMENT OF CIVIL SERVICE ELIGIBLE LIST FOR ASSOCIATE ATTORNEY, PERMANENT OR CONTINGENT PERMANENT STATUS AS AN ASSOCIATE ATTORNEY, OR ELIGIBLE FOR TRANSFER.

Duties Description PREFERRED QUALIFICATIONS: Applicants are required to have trusts and estates experience with a minimum of five years of litigation-related experience, including a knowledge of Surrogate's Court and Supreme Court practice and procedure and experience handling contested court proceedings. Applicants must have a working knowledge of the Surrogate’s Court Procedure Act, Supreme Court practice, E-Courts and the NYSCEF system. Familiarity with the Estates, Powers and Trusts Law is preferred. Applicants should possess strong writing and analytical skills.

The Charities Bureau of the Office of the Attorney General is a national leader in the oversight of not-for-profit organizations and represents the interests of the ultimate charitable beneficiaries in a wide range of matters. The Charities Bureau also appears in estate proceedings involving unknown beneficiaries and represents the interests of the State Comptroller in withdrawal proceedings brought by claimants seeking to withdraw funds on deposit with the Comptroller’s abandoned property fund. The Associate Attorney hired for this position will have the sole or primary responsibility for handling the representation of the Office of the State Comptroller on Abandoned Property Fund matters in the Surrogate’s and Supreme Courts in the First and Second Judicial Departments.

DUTIES:

•Appear in proceedings involving estates administered by the Public Administrator and estates with unknown beneficiaries.
•Represents the Office of the State Comptroller in withdrawal proceedings in Surrogate's Court and Supreme Court.
•Manage a full docket of withdrawal proceedings and Public Administrator accountings, including kinship hearings and other court appearances in connection with these proceedings.
•Represent the interests of the ultimate charitable beneficiaries in Surrogate's Court and Supreme Court proceedings involving trusts and estates with charitable interests, including contested probate proceedings.
•Review fiduciary accountings of charitable interests.
•Interact with a diverse group of colleagues, members of the public and other government regulators.
•Build professional relationships with partners in other government agencies.
•Perform other legal and office support duties as assigned.

This position requires that the selected candidate travel regularly within the Surrogate’s and Supreme Courts in the First (County of New York and Bronx) and Second Judicial Departments (County of Kings, Westchester, Putnam, Dutchess, Orange, Rockland, and Queens).
