Minimum Qualifications In order to be considered for appointment, candidates must be reachable from the appropriate Civil Service eligible list or be eligible for reassignment or transfer in accordance with Civil Service Law.
Duties Description Candidates selected as a Principal Attorney within NYSDOT’s Division of Legal Affairs will perform the following duties:
1. Lead multiple program areas within the Division of Legal Affairs.
2. Serve as part of the upper management counsel team for the Division. The Principal Attorney will supervise and oversee a large legal team of Supervising, Associate, and Senior Attorneys; covering multiple functional areas of law, including, but not limited to: Transportation Law, Highway Law, Finance Law, Civil Rights, Vehicle and Traffic Law, Public Officers Law, Executive Law, Human Rights, and Federal Highway, Railroad, Transit and Aviation Administration, as well as traffic safety, highway construction and maintenance, highway Beautification, and environmental matters.
3. Provide expert legal advice and assistance to agency counsel and support DOT’s mission and programs. Advise counsel on legal matters having a bearing on the agency’s work, procedures, and policies.
4. Ensure that the Department's interests are properly represented in all policy development, litigation, and administrative proceedings; as well as, for novel legal issues.
5. Manage, develop, and support a group of lower-level attorneys and legal supervisors engaged in the preparation of legal cases for which there is little precedent and/or which have a major impact on an agency's mission and program; analyzing legal opinions, briefs and other material; and preparing memoranda of law, interpreting and conferring with administrators or outside parties to legal action in order to mediate, negotiate, or
settle legal issues related to the agency's mission and programs.
6. Guide supervising attorneys and/attorney teams, in the; development of legal strategies, review of draft regulations, proposed pleadings, documents prepared in response to subpoenas, oversight of administrative actions, and implementation of recently enacted legislation.
7. Lead or oversee teams handling negotiations, legislation/regulation development, and legal issues that are
precedent setting, unique, or highly sensitive.
8. Foster cooperation and communication on legal matters with external stakeholders; including but not limited
to, sister states, federal and state agencies, authorities, municipalities, elected officials, industry representative,
and the public.
9. Coordinate and interpret pertinent policies, laws, rules, regulations, etc. for the compliance and enforcement
issues of the agency. Assist legal and programmatic staff in the development of procedures, training, and guidance, based thereon.
Responsibilities may include serving a role within the Incident Command System to support the department’s response to regional and statewide emergency situations.
Additional Comments *Telecommuting: The Department’s current telecommuting agreement is valid through January 31, 2023 and is subject to extension beyond that date.
