Duties Description • Supervise Remedial Bureau C (RBC), which consists of four sections. Provide day-to-day direction of the Bureau's Section Chiefs (SCs) and support staff. Provide overall management of the Bureau.
• Manage environmental remediation activities in the State Superfund (SSF) Program, Brownfield Cleanup Program (BCP), Environmental Restoration Program (ERP), and RCRA-C Corrective Action Program for sites located in DEC Region 3.
• Manage the Manufactured Gas Plant (MGP) Program statewide. Oversee the implementation of the MGP remedial programs for approximately 250 MGP sites in New York. Serve as the principal Division contact for MGP issues with the seven utilities operating in New York State with MGP remedial programs. Develop and implement technical standards and policies relating to the investigation and remediation of MGP sites.
• Work with SCs to prepare RBC's annual work plan and submit that work plan to the Division Director's (DD) Office, once prepared. The BD must also work with SCs to balance workload between sections depending on staffing changes and new projects.
• Review and approve Internal Guidance Policy No. 15 (IGP-15) requests, Work Assignment requests, Office of General Counsel (OGC) referrals, significant threat/non-significant threat packages, etc.
• Regularly meet with RBC and regional staff, regarding significant technical or policy issues on their sites. In the absence of a regional hazardous waste supervisor in Region 3, provide technical and administrative guidance to DER staff in Region 3.
• Handle/delegate to appropriate RBC staff any project-related requests from DER DD/Assistant Division Director (ADD) or DEC Executive.
• Recommend remedies for SSF, BCP, ERP, MGP and RCRA projects in compliance with applicable laws, regulations and guidance.
• Meeting Attendance. Meetings can range from 20% to 50% of the BD's weekly schedule. Meetings may be project related, policy oriented, or regularly scheduled (e.g., BCP Eligibility, SSF Reclassification, Tracking, OGC Docket).
• Develop/review Governor's, Commissioner's and Executive Staff correspondence.
• Immediately deal with Press and legislative Inquiries, mindful of established deadlines.
• Attend or assign to SCs on a rotating basis, BCP pre-application meetings scheduled by R3.
• Assign new BCP projects to RBC Sections or Region 3.
• Review, comment and approve BCP application packages, reclassification packages and BCP significant threat packages to circulate for others to review (e.g., DD, ADD, BDs, OGC). Approve non-significant threat packages for BCP sites and send these to the Bureau of Technical Support (BTS) for proper documentation in the DER database, the Unified Information System (UIS).
• Review and respond (to all DER/OGC reviewers) on BCP application approvals/Brownfield Cleanup Agreements (BCAs) when the DD's Office routes them. Incorporate, as needed, language regarding the eligibility of tangible property tax credits. The BD must also update the UIS 'Extra Details' section and enter information in the UIS Application Approval project under 'Current Status', to document decisions reached relative to program and tangible tax credit eligibility.
• Review and submit for Executive/DD approval fact sheets and other public notices. Transmit Executive/DD-reviewed fact sheets to the DER Policy and Planning Section for release.
• Attend all RBC and MGP project reviews and provide input to staff on how to move project forward and complete the cleanups.
• Review, comment and circulate Decision Documents, Proposed Remedial Action Plans and Records of Decision for DD approval. Resolve conflicting comments from reviewers; raise to ADD if necessary. Perform quality control of documents forwarded to the DD's Office.
• Review, comment and sign off on Certificate of Completion (COC) packages.
• Evaluate and approve requests from the RHWRE or RBC SCs to create 'P' or 'potential' sites.
• Attend weekly BD meetings and hold weekly SC meetings as necessary to discuss noteworthy topics and issues with SCs.
• Respond to FOIL requests and assign them to RBC staff, as needed.
• Review Monthly Report once SC updates are complete and notify SCs, and R3 staff of any overdue dates.
• Prepare for and attend monthly tracking meetings with ADD.
• Prepare for and attend quarterly OGC docket meetings with SCs and regional supervisors.
• Complete performance programs and performance evaluations for the RBC SCs and for support staff. Also approve leave requests and review/approve LATS time sheets for these staff.
• Monitor RBC budget and expenditures and request reallocations or additional allocations as applicable. If non personal service budget is limited, allocate that budget among sections.
