Minimum Qualifications Minimum Qualifications for provisional appointment:
You must be a qualified employee of New York State and have one year of permanent competitive or 55-b/55-c service as (A): Human Resources Specialist 1 (Labor Relations) or Human Resources Specialist 1 OR (B): Legal Assistant 2.
The promotional list for this position is not viable. Therefore, if no more than three qualified individuals are interested, it may be possible to make a permanent appointment via non-competitive promotion.

- Currently in the title of Human Resources Specialist 2 (Labor Relations) and an employee of DEC or
Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.

Eligible for transfer under Section 52.6: Must have current or prior permanent service in a title designated as 52.6 and within two salary grades of this position. Determination of titles that are 52.6 eligible can be found on the Department of Civil Service website, search “GOT-IT”
Duties Description Under the direction and guidance of senior level Labor Relations staff, the candidate for this position will:
Advise managers and staff in the application of all applicable CBA provisions, agency and state policies and procedures, and any applicable laws or rules that govern or impact agency staff;
Become proficient in labor relations procedures including but not limited to discipline, grievances, counseling guidance, workplace violence prevention, OTETA, EHS, and ADID processes;
Make recommendations to managers regarding counseling and progressive discipline;
Administer and implement all aspects of the grievance process including conducting Agency level/Step 2 meetings with grievances, union representatives, and program management;
Create and contribute to clear, accurate and comprehensive writing of grievance decisions, arbitration opening statements, arbitration closing arguments, agency policy, Notices of Discipline, Notices of Suspension, and all communications set forth by Labor Relations;
Conduct investigations, interrogations, draft investigative summaries, prepare Notices of Discipline and negotiate and implement settlements when applicable;
Represent the agency in person and remotely at grievance meetings and hearings, time and attendance and disciplinary hearings, and unemployment insurance hearings;
Participate in statewide Labor/Management Committee meetings;
Confer with the Governor's Office of Employee Relations and other control agencies as needed;
Provide direct and indirect supervision of a Labor Relations staff when applicable;
Travel when necessary and sometimes with very short notice (10%);
Communicate effectively with all program areas within NYSDEC regarding LR actions;
Work with and adequately provide notice to appropriate staff in properly effectuating LR actions;
Perform Labor Relations work with the best interest of the NYSDEC as the goal;
Consistently represent Labor Relations in a professional manner and demonstrate behavior and performance that sets a positive example for others;
Other duties and special projects as assigned.
Additional Comments Must have a valid driver’s license or demonstrate the ability to meet the transportation needs of the position. Travel may be required. Overtime may be required. Overnight travel may be required. Telecommuting may be available, will be discussed at interview.
