Minimum Qualifications • A Bachelor’s Degree from an accredited educational institution and a Juris Doctor from an accredited law school.
• Minimum of ten years of legal experience in, including the substantial experience in state or local government, including litigation, legal research, brief writing, and appeals.
• Admission to the New York State Bar is required.
• Demonstrated analytical skills, critical thinking skills, impartial judgment, and research aptitude.
• Excellent oral and written communication and legal research skills.
• Excellent oral skills for interviewing with experience required.
• Excellent writing skills for documenting interviews, summarizing evaluation findings, and drafting reports.
• Knowledge of NYS Freedom of Information Law and Open Meetings Law.
• Knowledge of NYS government procurement rules and processes.
• Knowledge of NYS, NYC, and federal laws and rules relating to employment, including Equal Employment and Reasonable Accommodations, among others.
• Knowledge of governmental investigative policies and procedures and reporting requirements preferred but not required.
• Knowledge of federal, state, and local civil and criminal laws, rules, regulations and procedures pertaining to civil and criminal investigations preferred but not required.
• Knowledge of investigative practices of Inspectors General or other governmental investigative agencies preferred but not required.
• Ability to work independently and with minimal supervision.

• Ability to interact effectively with department and agency staff, senior management and executive staff within the MTA/OIG and external offices and agencies.
• Subject to the approval of the General Counsel, this position is authorized for tele-working.

Duties Description • At the direction of the General Counsel, serves as a legal advisor, responsible for several mandatory functions including, among others, handling New York State Freedom of Information Law (FOIL) requests and issues; serving as OIG’s record retention officer; and advising on matters relating to Reasonable Accommodation, Equal Employment Opportunities (EEO) and other workplace rights.
• Handles all aspects of responding to OIG FOIL requests, keeps appropriate records of OIG FOIL process, and maintains OIG FOIL manual.
• Maintains familiarity with all aspects of New York State Open Meetings Law and provides assistance and feedback on OIG meetings as needed.
• Maintains awareness of current New York State government transparency developments.
• Handles all aspects of the OIG record retention process, including keeping appropriate records of OIG record retention and disposition process and maintaining the OIG Records Retention Manual.
• Maintains familiarity with all aspects of applicable New York State record retention laws and regulations and awareness of current record retention techniques and developments.
• Provides leadership, guidance, assistance, training, and feedback to the OIG record retention team on OIG record retention processes.
• Serves as liaison with New York State Archives and other New York record retention agencies.
• Provides guidance, assistance, training, and feedback with respect to OIG reasonable accommodation requests, including review and consultation on any proposed accommodation approvals and denials before issuance.
• Maintains familiarity with all aspects of applicable Federal, State and local laws and regulations concerning medical and disability reasonable accommodations.
• Maintains Reasonable Accommodations Process Manual.
• Handles all EEO complaints at OIG, including processing complaint intake, investigating thoroughly, referring a matter as appropriate, and maintaining appropriate records of OIG EEO matters.
• Maintains familiarity with all aspects of applicable Federal, State and local laws and regulations concerning EEO at the OIG workplace.
• Maintains awareness of EEO investigative techniques and developments.
• Provides guidance, assistance, and feedback with respect to equal employment complaints and issues.
• Provides guidance, assistance, and feedback on OIG office policies.
• Maintains familiarity with all aspects of applicable Federal, State, and local laws and regulations concerning office policies at the OIG workplace.
• Assist with reviewing and drafting OIG policies, forms, manuals, and handbooks as needed.
• Provides guidance, assistance, and feedback to the OIG procurement team on OIG purchases and contracts, including reviewing and drafting OIG contracts as needed.
• Maintains familiarity with all aspects of applicable New York State contract and procurement laws and regulations.
• Assists with litigation and represents the MTA OIG in judicial and administrative proceedings.
• Represents the MTA OIG at meetings with external Federal, State, and local agencies, officials of the MTA, MTA affiliates and their subsidiaries and contractors, as required.
• Maintains familiarity with OIG planning, conducting, and reporting on audit and investigative inquiries regarding all MTA-associated operations and management.
• Maintains awareness of current technology developments affecting case and office management.
• Provides legal and technical assistance to OIG Investigative and Audit staff as needed.
• Develops appropriate recommendations to improve OIG operations, cost-efficiency, and safety.
• Develops and maintains professional working relationships and continually gains knowledge of evolving MTA agency operations.
• Conducts applicable legal research and analyzes documents as needed.
• Draft legal documents as needed.
• Attends Senior Staff meetings.
• Travel within the MTA geographic jurisdiction may be required.
• Other duties as assigned by the General Counsel or the Inspector General.
