Minimum Qualifications NON-COMPETITIVE MINIMUM QUALIFICATIONS:
This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).
For the duration of the NY HELPS Program, this title maybe filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In May 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin.
At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
PROMOTIONAL MINIMUM QUALIFICATIONS:
You must be a qualified employee of New York State and have 1-year of permanent competitive or 55-b/55-c service as a Legal Assistant 1.
NON COMPETATIVE MINIMUM QUALIFICATIONS:
A bachelor's degree in a paralegal/legal assistant program from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA); and one year of subsequent full-time experience as a Paralegal/Legal Assistant or an associate degree in a paralegal/legal assistant program or a certificate in a paralegal/legal assistant program where either the degree or certificate was granted from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA) and two years of subsequent full-time experience as a Paralegal/Legal Assistant.
COMPETITIVE MINIMUM QUALIFICATIONS:
• Eligible for transfer under Civil Service Law
OR
• Reachable on the appropriate eligible list for this title and location in accordance with the provisions of Civil Service Law, Rules and Regulations.
Duties Description The incumbent will be required to:
· Assist in the preparation of materials, affidavits, arguments and legal papers in small claims cases, matters before the Division of Tax Appeals as well as cases in state and federal courts.
· Independently develop assigned cases or files to the point where an attorney need only sign off on the related papers or present the case to the administrative hearing judge.
· Prepare correspondence and all relevant case materials.
· Draft various legal documents and assist in the preparation of cases for litigation by completing a variety of activities.
· Conduct more complex research to assist attorneys.
· Assist attorneys in the drafting of answers, motions, affidavits or discovery responses.
· Coordinate activities between the Tax Department and United States Postal Service to obtain legally sufficient proof to establish the proper mailing of assessments issued by the Tax Department.
· Work with the Bureau of Conciliation and Mediation Services and the Tax Department mailing unit to obtain and analyze certified mailing records and to then prepare affidavits of mailing for litigation matters.
· Supervise the implementation of the computerized case management system adopted and utilized by the Office of Counsel.
· Organize responses to discovery demands in court proceedings.
· Draft and prepare motions for summary determinations.
· Work with the assigned attorney to edit and restyle papers as needed.
· Supervise Legal Assistant 1s, as required.
· Supervise the filing of answers and other legal papers with the Division of Tax Appeals.
· Analyze adversaries’ responses for their sufficiency and evaluate any objections received.
· Assist in the drafting of responses to interrogatories, notices to admit and requests for documents.
· Review and analyze legal papers served on the Tax Department.
· Prepare final documents for file closing.
