Minimum Qualifications Open to NYS employees with one year of permanent competitive service as an Associate Attorney, M-3/SG-28; OR who are M-2/SG-27 and eligible for transfer under Section 52.6 of the Civil Service Law. The transfer cannot be a second, consecutive transfer resulting in an advancement of more than two grades.

Duties Description Under the direction of the Enterprise eDiscovery Counsel within the Office of the Chief General Counsel in Albany, the incumbent will assist with providing ITS, including its program areas, project teams, Portfolios, and executive management, with legal advice concerning eDiscovery, data management and litigation issues.
Duties include, but are not limited to:
•Communicate with executive agency counsel and the Office of the Attorney General on eDiscovery and other IT issues impacting litigation and adversarial matters statewide
•Complete and/or review research, attend trainings, and stay up to date on current and emerging eDiscovery caselaw, issues, rules, best practices, and guidelines
•Assist IT and legal staff dedicated to technical and legal support of the State’s Office365 eDiscovery/Compliance Center toolsets and program
•Assist IT and legal staff dedicated to technical and legal support of the State’s Office365 eDiscovery platform
•Assist IT and legal staff dedicated to technical and legal support of the State’s Forensics Investigations Unit
•Provide trainings and guidance on eDiscovery services, caselaw, issues, rules, and best practices
•With the assistance of the eDiscovery Counsel and the IT manager of the Enterprise eDiscovery Services Team, draft and review policies related to eDiscovery, data management, and other matters as necessary
•Assist ITS, Portfolios, and the Attorney General’s Office in the review and response to Discovery Demands and other legal documents as needed
•With respect to electronic discovery or data management matters, liaise and maintain ITS relationships with Attorney General’s Office and NYS Inspector General
•Assist with internal investigations of fraud, waste and abuse of agency resources
•Assist with investigations of Acceptable Use violations, including use of forensic investigation tools and practices
•Support the General Counsel and eDiscovery Counsel with oversight and administration of the Counsel’s Office as needed
•Perform research on legal precedent regarding FOIL and opinions of the Committee on Open Government
•Process Agency FOIL requests as needed
•Supervise a staff of attorneys and technical staff in providing day to day services and guidance

Additional Comments Fingerprinting and background check are required for employment with ITS.
