This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply.
At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in an NY HELPS title, employees may take part in any promotion examination for which they are qualified.
This position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected. Candidate must be a graduate of an accredited law school with an LLB or JD degree and/or be eligible to take the NYS Bar examination.
NON-COMPETITIVE MINIMUM QUALIFICATIONS:
Assistant Attorney 1 (Hiring Rate $65,001) - Must be Law school graduation and/or eligibility for NYS Bar Admission
*You must present proof of eligibility to sit for the New York State Bar exam at the time of interview to be eligible for appointment.
Assistant Attorney 2 (Hiring Rate $72,032) - Candidates must have admission to NYS Bar.
Assistant Attorney 3 (Hiring Rate $79,928) - Candidates must have 12 months experience as an Assistant Attorney 2, or admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.
Senior Attorney (Hiring Rate $93,530) - Candidates must have 12 months experience as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.
55 B/C QUALIFICATIONS:
Individuals certified eligible for the 55b/c program under the Governor’s Program to Hire Persons/Veterans with Disabilities pursuant to Section 55b/c of the Civil Service Law will also be considered. To be considered, you must meet the minimum qualifications and provide a copy of your letter of eligibility with your response. Candidates must meet the non-competitive minimum qualifications listed above.
TRANSFER QUALIFICATIONS:
Candidates must have one year of permanent competitive or 55 b/c service in a title designated as appropriate for transfer in accordance with Section 52.6 or 70.1 of the Civil Service law.
Duties Description The Senior Attorney in the Legal Hearings Unit provides legal representation of the Uninsured Employers’ Fund (UEF) and Workers’ Compensation Board (Board) at Workers’ Compensation Hearings and other legal forums.
The incumbent will be responsible for:
• Reviewing case folders for the purpose of determining case history and status, and performing any necessary pre-hearing work
• Preparing for hearings by planning strategy and identifying appropriate issues for the hearing
• Representing the UEF at hearings in a professional, effective, and efficient manner
• Reviewing files for any necessary follow-up work, including the scheduling of medical exams, conducting depositions, and preparation of legal memoranda when necessary
• Reviewing decisions and taking necessary action
• Preparing LHU-1s after each hearing
• Handling large volume of cases in an appropriate and effective manner
• Determining when appeals are necessary and appropriate
• Preparing appeal documents and ensure they are clearly identifying appeal issues and grounds for appeal
• Appearing before the Board to advocate on behalf of the UEF in an effective and appropriate manner.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
