Duties Description The New York State Education Department is seeking candidates for an Associate Attorney position in the Office of State Review (OSR). The OSR assists the New York State Review Officer (SRO) in reviewing appealed decisions of impartial hearing officers concerning the identification, evaluation, program, or placement of children who have, or are suspected of having, an educational disability. Duties will include, but are not limited to the following:
• Assist in the effective supervision of Office of State Review Staff and operations by supervising Senior and Education Specialist Attorneys, rapidly screening and assigning appeals, tracking and reporting of cycle time, ensuring quality decisions are consistent with federal and State laws, developing and conducting employee evaluations and performance agreements, monitoring employee time, attendance, and leave requests, and implementing directives of SRO;
• Identify opportunities to further increase efficiency, improve consistency and prevent backlog of Section 4404 appeals by streamlining work processes, effectively using an electronic filing and case management system for control and performance assessment purposes, identifying and implementing strategies to further increase efficacy, and improve consistency and prevent backlog;
• In a timely manner, review and edit draft decisions for accuracy, thoroughness, consistency, and quality by creating and incorporating timelines for reviewing and editing draft decisions, maintaining compliance with cycle time, and demonstrating and sharing high level of expertise in legal research and writing and in special education law. If expertise in special education law is not currently possessed, then demonstrates a willingness and ability to develop such expertise; and
• Facilitate the education and training of OSR staff regarding the appeals process by identifying team members’ individual talents and needs for growth and making assignments accordingly, and recommending additional training or team members on particular subjects.

Additional Comments CONDITIONS OF EMPLOYMENT:
This will be a permanent appointment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree and Bar status will be required at the time of interview for all candidates. Candidates are required to possess Juris Doctorate degree AND be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity at the time of hire. Continued employment as an Associate Attorney is dependent upon maintaining registration to practice law in New York State. Failure to maintain registration to practice law in New York State will result in removal from employment. his position allows for the opportunity to telecommute up to 30% each bi-weekly pay period and is granted at the discretion of the supervisor and the appointing office.

This position leads to a maximum salary of $134,178 based on annual performance advances.
