Duties Description The Executive Director leads the Department of State’s Division of Consumer Protection (DCP), which is charged with enforcing more than 40 consumer focused laws, across five different statutes, and is subject to certain federal obligations as they relate to the U.S. Federal Trade Commission and the U.S. Consumer Product Safety Commission. The incumbent develops and implements policies and procedures to maximize resources while complying with all program obligations, including leading efforts to respond to the increasing challenges posed by a myriad of consumer issues including but not limited to robocalls, gender price equity, price gouging during emergencies, and consumer privacy. The incumbent also assists in managing activities of the Utility Intervention Unit, which is located within DCP, and participates in complex matters regarding utilities and rates, advocating for the most reasonable and best outcomes possible for ratepayers in the State of New York.
Specific Duties include, but are not limited to:
• Manage a staff of analysts, attorneys, community liaisons, investigators, and customer service representatives tasked with serving as the State’s top watchdog and think tank on a wide range of consumer protection issues.
o Review work products to check for quality, accuracy, timeliness, and completeness, and make edits or revisions, as necessary.
o Establish work procedures and keep track of daily work; review and approve time and attendance.
o Track progress and execution of assignments.
o Provide training, orientation, and duties and performance expectations.
o Monitor and evaluate performance.
• Coordinate with the Department of State’s other Divisions to effectuate investigations, resolution to consumer complaints, and public education campaigns and outreach activities.
• Supervise the enforcement of the New York State Do Not Call Law and the Division’s relationship with the U.S. Consumer Products Safety Commission.
• Ensure staff training on emerging consumer issues is conducted, as needed.
• Identify emerging consumer issues and develop possible recommendations for resolution.
• Oversee the creation and review of the Division’s quarterly legislative report.
• Provide the Department’s senior leadership team with updates and reports related to programmatic and operational progress.
• Travel is expected between the Albany and NYC office locations.
Minimum Qualifications Bachelor’s degree and seven years of relevant specialized experience, including five years managing work units or divisions, and four years in an area related to consumer protection education, oversight and/or enforcement. Two years must have been at a managerial level.
Education/Experience Substitutions
• Education: Four years of specialized experience; Associate degree and two years of specialized experience may substitute for Bachelor’s degree
• Experience: J.D. or Master’s degree may substitute for one year of specialized experience; Ph.D. may substitute for two years of specialized experience
PREFERRED QUALIFICATIONS:
• Experience in the formulation, implementation, and/or evaluation of program policies related to consumer protection.
• Experience with governmental regulatory, oversight, or investigative programs; experience in leading teams of professional and support staff.
• Familiarity with New York State government policies and programs.
• Experience working within the NYS Executive branch of government.
• Advanced degree such as a Masters, J.D., or PhD, related to public administration, public policy, law, or other areas with a nexus to consumer protection.
