Duties Description STANDARD DUTIES:

Review hearing request files to ensure files are legally and factually correct. Evaluate whether determinations adhere to law, precedent or policy and are supported by fact finding; issue revisions, additional and alternate determinations when appropriate; and return the file to adjudication offices for further fact finding and/or correction, revision, or redetermination when necessary. Gather, assemble evidence as appropriate. Prepare case files for ALJ offices. Schedule and prepare witnesses for assigned hearings, prepare questions for all parties, note key documents to be presented in support of the Commissioner of Labor's position. Research relevant citations, represent the Comm. of Labor by making opening statements, conducting direct and cross examination of witnesses, making relevant objections, introducing evidence, and making closing arguments supported by proper citation to legal authority. Prepare post hearing reports including adjournment memoranda, closing reports, and recommendations for appeal. Advise the UI office when determinations have been added, modified, or withdrawn.

Minimum Qualifications MINIMUM QUALIFICATIONS:

Candidates reachable on the Civil Service Eligible list(s) will be canvassed. However, you may also apply if you are eligible for appointment by one of the following qualifications:

Reassignment Qualifications:
An employee with one year or more of permanent, contingent-permanent or 55 b/c service as a Senior Unemployment Insurance Hearing Representative, is eligible for reassignment. An employee with less than one year of permanent competitive service is eligible for reassignment to a different geographic location if reachable for appointment on a current eligible list for this title and location.

70.1 TRANSFER QUALIFICATIONS:
One year of permanent or contingent-permanent as a Grade 18 or higher determined to be similar by Civil Service.

Provisional Qualifications:
A New York State Department of Labor employee with at least one year of permanent, competitive or 55-b/55-c service as service as an Investigative Officer 1, Investigative Officer 1 (various language parenthetics), Labor Standards Investigator, Labor Standards Investigator (various Language parenthetics) Labor Services Representative, Labor Services Representative (various language parenthetics), Labor Services Representative (Local Veterans Employment Representative), Unemployment Insurance Investigator, Unemployment Insurance Investigator (Spanish Language), or Unemployment Insurance Reviewing Examiner. The appointed candidate would have to take, pass and be reachable on the next holding of the examination to be appointed permanently.
