Duties Description Under the general direction of the Supervising Attorney, the Associate Attorney would assist in administering the Full Board Review (FBR) process, both discretionary and mandatory. Duties would include, but are not limited to:
• Triage and Data Reports on FBR Cases: Coordinate with administrative support staff to properly triage all FBR cases received on a monthly basis. Create monthly reports which reflect statistical values of cases received and processed during the month, in addition to maintaining an up-to-date status on existing inventory. Any significant recurring issues or issues on new legislation that are noted should be brought to the attention of the General Counsel and/or Deputy General Counsel.
• Monitoring and Supervision of Senior Attorney work: Assign FBR cases on a monthly basis according to OGC procedures. Assignments should be objective and equitably distributed, with recurring issues assigned to particular Senior Attorneys where appropriate to allow for the expeditious review and processing of the FBR. Monitor attorney assignment sheets to ensure reviews are being performed in a punctual manner. Timely identify the need for and provide prompt and targeted training where appropriate.
• Review Memos and Ensure Compliance with OGC Standards: Review Sustain, Amend, and Rescind Memos for the following: (a) accurate statement of the facts, (b) consideration of all evidence in record, (c) whether all issues were addressed, (d) whether the Memo has errors of law or fact, (e) whether new evidence submitted which could not have been produced was considered, and (f) whether the proposed finding is based upon a preponderance of the credible evidence. Edit memos which require minor changes or return to Senior Attorney for more significant changes, provide approval for submission to the Board Panels, review and manage any rejections from the Board Panels, prepare cases for inclusion in the monthly Board meeting, and follow through on post-meeting activity. Serve as liaison for all decisional workflow with Board Members, Vice Chair, and Chair.
• Human Resources/Personnel: Supervise staff of Senior Attorneys, including time and attendance, promulgation of performance programs, timely performance evaluations, and probationary reports. Provide counselling, where necessary, and commence disciplinary action if appropriate.
• Legal Opinions and Memoranda: Prepare legal opinions and memoranda in response to inquiries regarding the Workers' Compensation Law from the Chair, the Board, General Counsel, other departments within the Board, other agencies, and the public.
• Other Functions: Upon direction of General Counsel, based upon the professional needs of the Board, serve as Associate Attorney in other legal functions within the Office of General Counsel.
Minimum Qualifications Candidates must be reachable on the appropriate Civil Service eligible list.
OR
Candidates must have one year of permanent competitive or non-competitive 55 b/c service as an Associate Attorney or be eligible to transfer under section 52.6 of the Civil Service Law.
OR
Non-Competitive Promotion Qualification:
If the number of eligible interested candidates is three or less, the agency, at its discretion, may nominate a candidate for a non-competitive promotion under the provisions of Section 52.7 of the Civil Service Law. If approved by Civil Service, this would be considered a permanent appointment.
In order to be eligible for an NCP, candidates must be an employee of the Workers’ Compensation Board (WCB) and have two years of permanent competitive or 55-b/55-c service as a Senior Attorney.

Provisional Qualifications:
Must be a qualified employee of New York State and have had two years of permanent competitive or 55-b/55-c service as a Senior Attorney.
If appointed provisionally, the incumbent will need to take the next Civil Service examination for this title and pass with a score that will be immediately reachable on the resulting eligible list. Failure to take, pass and achieve a reachable score on the examination may result in revocation of the appointment.
Additional Comments Please Note: This position requires both in-office and remote work. A hybrid telecommuting schedule can be discussed with the hiring manager during the interview.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
