Duties Description Reporting to the Director of Charitable Gaming, the incumbent will perform research, conduct program planning, policy development, analysis and audits of charitable gaming industry metrics, applicants, and licensees. Assist with the administration of the Games of Chance Licensing Law, Bingo Licensing Law, and Bingo Control Law as prescribed by articles 19-A and 14-H of the General Municipal Law and 19-B of the Executive Law.

Specific duties will include, but are not limited to:

Research/Marketing/Stakeholder Education:

• Identify and analyze stakeholders, and assess their level, interest, or influence/roles, applicability in charitable gaming.

• Research and develop educational, resource, marketing materials, and/or training materials to assist charitable gaming stakeholders (i.e., municipalities) in the education and understanding the available options for charitable gaming, processes, licensing, and resources that are available to assist them.

• Market and promote the business of charitable gaming to those interested parties via seminars or workshops (in person or remotely) and by developing materials such as brochures or guides.

• Provide consultation and advice to stakeholders throughout the State with respect to criteria for licensing, interpretation of statutes, rules, regulations, and inspections. This may include industry stakeholders and/or local law enforcement as to the statutes, rules, and regulation.

• Represent the Division of Charitable Gaming at trade shows, conferences, or workshops.

• Collaborate in teams or individually to conduct educational and training seminars with municipal listing authorities on holding Bingo, Games of Chance, licensing, and financial requirements.

Application Review/Technical Guidance:

• Review for approval or denial, applications of charitable organizations (i.e. VFW, American Legion, Disabled American Vet, Elks Lodge, Moose Lodge) who seek to conduct charitable gaming in NYS.

• Assist the Assistant Director of Charitable Gaming with office operations including resolving day-to-day operational problems.

• Review and logging/ incoming correspondence and prepare responses when needed. Handle telephone inquiries.

• Provide technical assistance in problem solving to businesses, non-profit entities or individuals contacting the Division seeking to understand the general municipal law in relation to Charitable Gaming. This may require on-site inspection of equipment and games.

• Serve as liaison and provide technical information with industry, non-profits, associations, and governmental entities.

• Review for approval or denial, bell jar ticket submissions from licensed bell jar game manufacturers.

Charitable Gaming Economic Tracking and Growth and Policy Development:

• Conduct research, analysis and input on legislative and regulation development and industry guidance to the Assistant Director of Charitable Gaming and the Director of Charitable Gaming.

• Analyze and interpret statistical data to identify significant differences in relationships among sources of information.

• Compile economic/business development information needed for program management; identifies trends and common roadblocks for charitable gaming businesses to be successful based upon the general municipal law.

• Evaluate quality control and quality assurance procedures for deviations or deficiencies in policy and regulatory compliance.

• Compile and make recommendations on metrics and key performance indicators for the management of risk and compliance in Charitable Gaming.

• Monitor compliance of licenses or registered organizations with applicable laws, regulations, policies, and procedures; conducts inspections; audits books and records for inventory discrepancies or other aspects of regulatory compliance; prepares written correspondence summarizing audit findings.

• Collaborate with staff to assist Assistant Director to develop guidelines, policies, and procedures and develop alternative/strategies for programs internally or externally on a statewide level.

• Maintain spreadsheets and database to provide analytic information to ensure accurate and timely information is readily available.

• Formulate Charitable Gaming policies, procedures, work programs, and standards of operations.

• Participate in essential processes for the division as well as determine the methods and means for policy objectives to be achieved.

• Perform assigned activities with relevant independences and exercising good judgement and professional discretion.

Investigate Complaints of Charitable Gaming Violations:

• Monitor and conduct compliance inspections of locations where charitable gaming is being conducted and where gaming equipment is being stored based on complaints, internal audits and referrals from other agencies to ensure that charitable gaming is being conducted fairly and in compliance with applicable rules and regulations.

• Conduct interviews and prepare comprehensive report of compliance findings for administrative adjudication or referrals to other enforcement agencies when necessary.

• Provide testimony for criminal and administrative proceedings.

Minimum Qualifications Permanent Qualification: Candidates must currently be reachable for appointment on the current Program Outreach Specialist 1 eligible list

One year of permanent, contingent permanent, or 55 B/C service allocated to a Grade 16 or higher eligible for transfer and determined to be similar by Civil Service.

52.6 Transfer Qualifications:
One year of permanent, contingent permanent, or 55 B/C service allocated to a Grade 16 or higher eligible for transfer and determined to be administrative by Civil Service.

Open to the Public: Minimum Qualifications: Six years of professional experience in a position where the primary (50% or more of the time) responsibility was the extensive promotion and representation of programs and services for public and/or private organizations for the purpose of increasing participation in, or utilization of, these programs and services.

Substitution:

• A bachelor’s degree* may be substituted for up to four years of the above experience.

• An associate degree* may be substituted for up to two years of the above experience.

Qualifying professional experience includes, but is not limited to professional experience in corporate, not for profit, private organizations and governmental agency public relations; advertising; marketing, or promotion of public programs and services. Duties must have included creating, scheduling, organizing, and promoting outreach activities**, including conferences, workshops, training sessions and other public events, to promote agency programs to target populations.

**An outreach activity is any activity which promotes and educates or informs the public about existing or new programs and services to populations who might not otherwise have access to those programs and services of an agency or organization.

Examples of Non-Qualifying Experience: Experience primarily in or restricted to administrative assistance, art/graphic design or copywriting, recruitment and placement services, provision of program information and other direct contact with clients or potential clients of program services and direct customer sales.

NY HELPS:

This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).

For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply and complete a probationary period.

At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.

Individuals certified eligible for the 55-b/c program under the Governor's Program to Hire Persons/Veterans with Disabilities pursuant to Section 55-b/c of the Civil Service Law are encouraged to apply. Prohibition against Playing and Wagering:

Commission employees and family members residing in their households are prohibited from purchasing Lottery tickets or claiming Lottery prizes. Commission employees are prohibited from wagering upon any horse racing, commercial gaming, video lottery gaming, Indian gaming, charitable gaming activities, interactive fantasy sports, and mobile sports wagering within the State. To avoid any appearance of impropriety of conflict of interest, Commission employees will be prohibited from all aspects of promoting, operating, and playing in any charitable gaming, which includes bingo and games of chance such as raffles, whether the organization conducting the game is required to be licensed by the Commission. The prohibition placed upon each Commission employee from assisting with any charitable gaming does not apply to the employee's family unless the employee thinks it presents a conflict of interest related to his or her job duties. Commission employees must also avoid any outside activities that could interfere or be perceived to interfere with their job duties.

Pre-Employment Restrictions:

The law that established the Commission (specifically, Section 107 or the Racing, Pari-mutuel Wagering and Breeding Law) prohibits any person from being employed by the Commission if, during the period commencing three years prior to employment, such person held any interest in, or employment by, any corporation, association or person engaged in gaming activity with the State.
