Duties Description The New York State Department of Labor Counsel’s Office is seeking a highly skilled Supervising Attorney to join our team and play a key role in the administration and enforcement of the Labor Law. Under the supervision of a Principal Attorney, the Supervising Attorney will provide expert legal advice to Department of Labor (Department) staff and manage the day-to-day operations of legal staff in their assigned portfolios. The Supervising Attorney will supervise Associate Attorneys working in a wide range of program areas related to the Department’s enforcement of the Labor Law and employer operations. The Supervising Attorney is expected to advise the Department’s leadership team on legal issues and oversee enforcement and litigation matters arising within their assigned portfolio. The Supervising Attorney will act as a key liaison between the General Counsel’s Office and the Department’s program areas, balancing legal risk with operational and policy objectives.
The Supervising Attorney will act as lead counsel for matters involving complex legal issues, including novel areas of law, and high-profile or multi-party litigation; review the work of Associate Attorneys; and regularly serve as a legal advisor to the Department’s leadership team. The Supervising Attorney may be required to provide subject matter expertise to the General Counsel and Commissioner of Labor, as well as the Governor’s Office, legislature, and other stakeholders.
Specific duties include but are not limited to:
• Supervise Associate Attorneys, as well as other Counsel’s Office staff, and review and approve completed work, observe and monitor hearings, and review decisions from administrative law judges.
• Provide counsel and advice to Department staff regarding the interpretation and implementation of legislation, regulations, and court decisions.
• Assign and monitor caseloads, including review and approval of a wide variety of legal documents including documents related to administrative hearings and litigation.
• Provide training and professional development opportunities for staff, including developing and implementing general legal training programs and programs specific to the needs of the Department.
• Evaluate and approve legal interpretations, advisory opinions, forms, policy memoranda, and other documents prepared by staff.
• Draft and revise complex, sensitive, or novel legal interpretations, advisory opinions, and other documents.
• Discuss and negotiate with attorneys about claims, complaints, lawsuits, and other legal matters.
• Advise Department staff and representatives from other state and local agencies about legal matters.
• Oversee litigation strategy for cases involving the Department, coordinating with the Office of the Attorney General when necessary.

Admission to the New York State Bar and current registration to practice law in New York State is necessary for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.

Current Department of Labor employees only, with at least one (1) year of permanent, contingent-permanent, or 55b/c service in a Supervising Attorney if you have less than one (1) year, you must be reachable on the current Supervising Attorney eligible list for this location, if one exists.
52.7 Non-Competitive Promotion (NCP) Qualifications: (DOL EMPLOYEES ONLY)
To be eligible for NCP, candidates must be in the Department of Labor promotion field and have one (1) year or more of permanent, contingent-permanent or 55 b/c service as Associate Attorney or Associate Attorney (Various Parenthetics). If 3 or fewer qualified Department of Labor Associate Attorney or Associate Attorney (Various Parenthetics) respond to this posting, Civil Service may approve the permanent appointment of one of the qualified Associate Attorney or Associate Attorney (Various Parenthetics) without further examination.
Note: Non-competitive refers to not competing in an examination; the appointment will be competitive.
52.6 Transfer Qualifications:
Current State employees with one (1) year of permanent or contingent-permanent service as salary grade 29/M3 and designated administrative under Section 52.6 of the Civil Service Law.*
*Transfer candidates must also possess a law degree from an accredited college or university and be able to provide evidence of current registration to practice law in New York State.

Provisional Qualifications: (DOL EMPLOYEES ONLY)
Associate Attorney or Associate Attorney (Various Parenthetics), with one (1) year of permanent, contingent-permanent or 55 b/c service may apply. The appointed candidate would have to take, pass and be reachable on the next holding of the examination to be appointed permanently.

Omissions or vagueness may not be interpreted in your favor. Additionally, in accordance with Civil Service Law, provisional service immediately prior to a permanent appointment to this title is now credited towards the completion of probation upon permanent appointment.
Preferred Qualifications:
• Ability to build and maintain strong working relationships with other government agencies, regulators, and a diverse set of stakeholders.
• Experience with complex state or federal litigation or enforcement matters.
• Strong written and verbal communication skills, including the ability to communicate complex legal concepts clearly to non-legal staff and leadership.
• Strong analytical, critical thinking, and problem-solving skills.
• Ability to handle multiple and shifting priorities and be able to meet both formal and informal deadlines.
• Ability to work independently and in a team environment.
• Attention to detail.
• Attorneys with immigration experience are encouraged to apply.
Additional Comments Position specific job duties may include occasional altered work schedule or job assignments which require availability and willingness to work occasional evenings and/or out-stationed assignments.
Additional location pay is available for the following counties: Bronx, Kings, Nassau, NYC-Manhattan, Queens, Richmond, Rockland, Suffolk, and Westchester, Dutchess, Orange, and Putnam.
