Duties Description Responsibilities:
Working as Administrative Law Judges, the incumbents of these positions will be responsible for the review and conduct of hearings on individual eligibility determinations for health insurance programs.
Reporting to a Hearing Officer 3 (Principal Hearing Officer), the incumbents of these positions will work closely with Appeals Staff to ensure that individuals receive prompt resolution to their appeals. Such Duties shall include:
• Hearing Officers 2 will serve as Senior Administrative Law Judges presiding over impartial hearings for applicants and recipients whose eligibility appeals originate from notices that are issued by the NY State of Health via the NY State of Health system and via the newly created Medicaid Eligibility Client Management system (MECM). Issue areas are expected to include Non-MAGI Medicaid eligibility (e.g. SSI (SSI recipients, State Supplement only), SSI-related Medically Needy (Aged, Blind, Disabled), ADC-related Medically Needy (Under 21 years old, Parent Caretaker Relatives, Pregnant Women), COBRA, Medicare Savings Program (MSP), AIDS Health Insurance Program (AHIP), Foster Care (IV-E or Non-IV-E), Medicaid Buy-In for Working People with Disabilities (Basic Group), Medicaid Buy-In for Working People with Disabilities (Medical Improvement Group), Medicaid Cancer Treatment Program (MCTP for Breast and Cervical and Colorectal and Prostate), Resident of Home for Adults run by LDSS, OMH Residential Care Centers/Community Residences, Medicaid Separate Determination Cases, Foster Care Cases, Adult Homes/Assisted Living/Congregate Care Cases, Nursing Home Cases Managed Long Term Care Plan Referrals Supportive/Specialized Housing - AIDS Related) as well as appeals which may have issues pertaining to MAGI Medicaid Qualified Health Plans with or without Advanced Payment of the Premium Tax Credits and Cost-Sharing Reductions, the Essential Plan, and Child Health Plus.
• Hearing Officers 2 review fair hearing requests related to eligibility for health insurance programs and determine probable issues and apply the appropriate regulations and law. Complete all assigned hearings and issue timely and accurate decisions.
• Hearing Officers 2 issue final and binding decisions, rule at the hearing when necessary, and primarily adjudicate complex Medicare and Medicaid hearings with more assigned daily calendars and hearings per week than Hearing Officers 1.
• Hearing Officers 2 will manage their adjourned and personalized hearings and meet timeliness standards.
• Hearing Officers 2 will adjudicate in-person hearing requests, and video conference hearings when necessary.
• During hearings, Hearing Officers 2 instruct parties of their rights and maintain an atmosphere of fairness, impartiality and due process; administer oaths and affirmations; elicit testimony from parties relative to the issues of the hearing and question witnesses to obtain facts.
• After hearings, Hearing Officers 2 are required to write dismissals and decisions that meet all regulatory standards pertaining to the issue at hand; which may include additional research into laws, regulations, and policies.
• Additional Hearing Officers 2 duties include review and adjudication of expedite and other requests; review of validity of appeals and request to vacate dismissals. Hearing Officers 2 may be assigned overflow and complex MAGI appeals as needed to meet regulatory time frames.
• Hearing Officers 2 may be responsible for supervising other members of the Appeals staff as needs arise.

Minimum Qualifications Current NYS Department of Health employee with permanent or contingent-permanent, competitive status as a Hearing Officer 2, G-27 OR a NYS employee with one year or more of permanent or contingent-permanent, competitive service in a title at or above a G-25 and deemed eligible for transfer to a Hearing Officer 2, G-27 under Section 52.6 of the NYS Civil Service Law.

Provisional Appointment: In the absence of an eligible list with three or more candidates willing to accept a position, a temporary provisional appointment may be considered.

Promotional Provisional: Current NYS Department of Health employee with one year or more of permanent or contingent-permanent, competitive status as a Hearing Officer 1.

If three or fewer New York State Department of Health promotional candidates respond to this notice, the agency may, at its discretion, nominate a qualified employee for non-competitive promotion under the provisions of Section 52.7 of the Civil Service Law.

Preferred Qualifications: The preferred candidate will have 4+ years experience in conducting adminstrative hearings with mutliple parties including agency representatives and attorneys. Candidates must also have the ability to manage a heavy hearing calendar and ability to pivot amongst mutiple areas of the law. Experience and knowledge in both Non-MAGI and MAGI based Medicaid, experience working with public health insurance programs and/or with a legal services organization specializing in health law, in addition to experience in administrative law hearings. The candidate will also have a willingness to learn and the ability to adapt. Strong written and oral communication skills are a must. Preferred candidate should also have the ability to learn new computer systems and be able to navigate those systems with ease.

Additional Comments Please be advised that all hires into these positions must submit to mandatory fingerprinting and an associated background investigation, including state and national criminal history record checks, to ensure suitability for employment and/or continued employment. Candidates will not be required to pay the fees associated with mandatory fingerprinting. Depending on, the criminal convictions discovered, or any falsified or omitted information revealed, the investigative findings may bar appointment or result in removal after appointment. Please note that the selected candidate, should they continue to have access to Federal Tax Information (FTI), must submit to a mandatory reinvestigation every five (5) years.

This position may require travel throughout New York State including overnights to areas not served by public transportation.
