Duties Description The Variance Unit provides a service to design professionals, the code enforcement community, and the public by responding to requests for Variances to the Uniform Fire Prevention and Building Code.
The Manager, Variance Unit duties in Building Standards & Codes will include but are not limited to the following:
• Oversee the variance unit operations for the Eastern region of the state relating to NYS Uniform Fire, Building, and Energy codes.
• Administer technical assistance and training programs to local code enforcement officials, the design professions, and the public.
• Assist architects, engineers, and local code enforcement officials in the review of construction documents for conformance with the NYS Uniform Fire Prevention and Building Code and rendering of official interpretations.
• Use their experience in consulting, evaluating, planning, designing, and engineering of construction projects to assist the public, code officials, and design professionals with helping to develop an engineering analysis and mitigating factors in assisting regional boards with granting variances.
• Apply their education, knowledge, and experience of the mathematical, physical, and engineering sciences to assist Professional Engineers and Registered Architects in applying for a variance, preparing code analysis and supporting documents.

Minimum Qualifications MINIMUM QUALIFICATIONS:

COMPETITIVE MINIMUM QUALIFICATIONS:

55 B/C APPOINTMENT: This position is eligible for 55B/C designation and candidates with 55B/C eligibility are encouraged to apply. Candidates must meet any open competitive minimum qualifications and must submit their current 55B/C eligibility letter along with their application.

CIVIL SERVICE LIST APPOINTMENT: Candidates must be reachable on the appropriate Civil Service eligible list.

TRANSFER QUALIFICATIONS: Permanent service in this title or one year of permanent competitive or 55-B/C service in a title SG-25 or higher and otherwise eligible for transfer under Civil Service Law.

PROVISIONAL QUALIFICATIONS: Based on the results of the canvass of the current eligible list for the Manager Building Standards & Codes the Department may elect to make a provisional appointment to this position rather than a permanent appointment. If a provisional appointment is made, the appointed candidate will be required to compete in the next holding of the Manager Building Standards & Codes exam and be reachable for appointment from the newly established eligible list.

The minimum qualifications for Provisional appointment are:

One year of permanent, contingent permanent, or 55 B/C service as a Department of State employee as a Professional Engineer 1 (Civil/Construction), Professional Engineer 1 (Civil/Structural), Professional Engineer 1 (Fire Protection), Professional Engineer 1 (Mechanical), Senior Architect, or Senior Building Construction Engineer AND you must have a New York State licensure and current registration as a Registered Architect or Professional Engineer.

52.7 NON-COMPETITIVE PROMOTION (NCP): In accordance with Section 52.7 of the Civil Service Law, if the number of qualified candidates who apply for the position is three or less, a permanent appointment can be made, at agency discretion, by non-competitive promotion of an applicant who meets the minimum qualifications. To qualify, you must be a current Department of State employee and have one year of permanent, contingent permanent, or 55 B/C service as a Professional Engineer 1 (Civil/Construction), Professional Engineer 1 (Civil/Structural), Professional Engineer 1 (Fire Protection), Professional Engineer 1 (Mechanical), Senior Architect, or Senior Building Construction Engineer AND you must have a New York State licensure and current registration as a Registered Architect or Professional Engineer.

Note: Non-Competitive refers to not competing in an examination; the appointment will be competitive.

Positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $4,000 annual downstate adjustment. OR
Positions located within Orange, Dutchess and Putnam are also eligible to receive an additional $2,000 Mid-Hudson adjustment.
For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.

NOTE ON TELECOMMUTING: The Department of State employees may be approved for a maximum of 50% telecommuting, however, they are required to apply and obtain approval through management in accordance with The Department of State Telecommuting Program Guidelines.
