Duties Description The New York State Education Department’s (NYSED) Office of Special Education and ACCES (OSEA) is seeking candidates for an Associate in Education of Children with Disabilities position in the Office of Special Education (OSE) in the State Complaint and Document Retention Unit. OSE works to promote educational equity and excellence for students with disabilities, oversees the implementation of federal and State laws and policies for students with disabilities, provides general supervision and monitoring of all public and private schools in New York State serving preschool and school-age students with disabilities, and provides technical assistance to parents and school districts. The State Complaint and Document Retention Unit is responsible for investigation of state complaints, oversight of OSE Freedom of Information Law (FOIL) requests and development, implementation, and maintenance of an office-wide electronic filing system. Under the direction of the Associate Attorney, the incumbent of this position will be responsible for activities, to ensure NYSED compliance with the federal Individuals with Disabilities Education Act (IDEA). Duties of this position include, but are not limited to, the following:

• Receive, review, and investigate state complaints, gather important information and relevant facts to inform and develop determination of findings, and, as appropriate, develop compliance assurance plans.
• Collaborate with OSE Special Education Quality Assurance (SEQA) units, as appropriate and under the direction of the Unit Supervisor, to ensure corrective actions resulting from State complaints are disseminated to regional units to ensure timely resolution.
• Assist in the preparation of responses to FOIL requests, including the review of redacted documents to ensure personally identifiable information is appropriately and accurately redacted.
• Review documents to ensure the appropriate purging of outdated and/or duplicative documents and retention of appropriate office-wide documents.
• Contribute to the development and implementation of policies and procedures for State complaints, FOIL requests, and retention of an electronic system of officewide documents.

Minimum Qualifications NY HELPS
This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).

For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.


NON-COMPETITIVE MINIMUM QUALIFICATIONS:
To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position. The qualifications are:

• Master’s degree or higher in special education, reading education, elementary or secondary education, psychology, school psychology, school counseling, guidance and counseling, communications disorders, or speech pathology; AND New York State permanent or professional certification as a teacher of special education; a teacher of the deaf and hearing impaired, blind or partially sighted; speech and hearing handicapped; as a school psychologist; or New York State licensure as a speech/language pathologist; AND four years of professional experience in special education service delivery, administration of special education programs for ages 3-21, evaluation for special education eligibility, teaching children with disabilities, or designing and/or developing special education programs.

Substitution: a doctorate can substitute for one year of non-specialized experience.

PROMOTION: Current NYSED State employees must have one year of permanent service as an Assistant in Education of Children with Disabilities.

COMPETITIVE MINIMUM QUALIFICATIONS:

Reassignment: Candidates must have one year of permanent competitive or 55b/c service as an Associate in Education of Children with Disabilities.

Eligible List Appointment: Candidates must be reachable on the Civil Service eligible list for this title. If you are on the Civil Service eligible list for this title, you may receive a canvass letter. You must complete and return it as instructed on the letter.

Section 70.1 Transfer: Candidates must meet the eligibility requirements and have one year of permanent competitive or 55b/c service in any of the Professional Educator Titles (Grade 22, 26, and 28), as indicated here: http://www.nysed.gov/hr/section-701-transfer-determinations-between-professional-educator-titles-grade-22-26-and-28.

55b/c Appointment: This position is eligible for 55b/c designation and candidates with 55b/c eligibility are encouraged to apply. Candidates must possess a current 55b/c eligibility letter and the following minimum qualifications:

Additional Comments CONDITIONS OF EMPLOYMENT: These will be permanent, competitive appointments or permanent non-competitive appointments. For 55b/c appointment, candidates must possess the minimum qualifications, a current 55b/c eligibility letter and is subject to verification of applicant eligibility.

Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree and experience will be required at the time of interview for all candidates. Verification of certification/licensure will be required at the time of interview for all candidates. Candidates are required to possess certification/licensure at the time of hire. Continued employment as Associate in Education in Children with Disabilities is dependent upon maintaining licensure/certification, including adhering to all relevant professional development and training requirements as specified by the Office of Professions. Failure to maintain licensure/certification and current registration will result in removal from employment. This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period at the discretion of the unit supervisor. This position will require 10% statewide travel.

Federal law may impose additional requirements or restrictions regarding positions that receive federal funding.

This position leads to a maximum salary of $125,001 based on annual performance advances. For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
