Minimum Qualifications The ideal candidate will have bankruptcy and litigation experience; excellent writing, analytical, and oral advocacy skills; and a demonstrated commitment to public service. Experience with New York State Tax Law and Public Health Law is preferred. Five (5) or more years of bankruptcy experience is required.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to the New York State bar. In addition, the Public Officers Law requires that attorneys in the OAG be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The New York State Office of the Attorney General (OAG) is seeking a bankruptcy litigator to serve as an Assistant Attorney General in the Commercial Litigation Section of the Litigation Bureau in the New York City office.


This position offers an ideal mixture of bankruptcy practice with commercial litigation. The selected candidate will represent the interests of the State of New York as creditor or regulator in bankruptcy cases in litigated and non-litigated matters, including as a defendant in adversary proceedings, as well as represent state agencies in state and federal courts in legal actions involving administrative law, state regulation, taxation, finance, insurance law. The Assistant Attorney General will also be called upon to advise, educate, and counsel state agencies on bankruptcy and bankruptcy-related issues and consult with other bureaus of the OAG as the need for specialized bankruptcy expertise arises.


Attorneys assigned to the Commercial Litigation Section primarily represent the Department of Taxation and Finance, the Department of Financial Services, the Department of State, the New York State Insurance Fund, and the Department of Motor Vehicles. Cases frequently have significant financial and policy implications for the State of New York and present questions of statutory and regulatory interpretation and constitutional law.
