Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as an Associate Attorney Health Care Regulation (M-3); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at SG-27 or M-2 or above and eligible for transfer under Section 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer under Section 52.6 of the Civil Service Law must also be a graduate of an accredited law school with an LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration).
Strong legal writing skills and excellent oral communication skills. Must be able to prepare detailed and well-written affidavits, briefs, and other papers for use in legal proceedings. Must also have demonstrated good decision-making ability, the ability to prioritize cases and workload, must be able to comply with court imposed deadlines. Experience with the Public Health Law, Social Services Law, applicable regulations, and Medicaid is desired. The preferred candidate should have supervisory experience. Must be able to perform successfully in a high volume, deadline driven environment.
Duties Description Work with the Attorney General’s office in legal matters involving the Department of Health; review requests for legal action received from program staff to determine appropriateness, prepare referral letters to the Attorney General, and provide aid to the Attorney General in developing the agency’s case; convey the agency position to the Attorney General’s office, advocate the agency position, and ensure that the agency’s position is expressed persuasively and appropriately by the Attorney General’s office; prepare and/or review indicated affidavits, briefs, and other papers for use in legal proceedings; review legal papers served or received to determine appropriate responsive action, such as subpoenas, levies, bankruptcy notices; prepare memoranda advising of developments in legal proceedings and the ramifications of court orders and decisions, and respond to requests from program staff for opinions and information concerning legal proceedings. This position will have a supervisory role advising Bureau of Litigation (BOL) Senior Attorneys and legal assistants on matters related to litigation, provide guidance in the completion of their work; providing litigation-specific training to BOL personnel with respect to issues in which the incumbent has developed expertise; developing standardized procedures for BOL staff to follow in carrying out routine legal tasks for which the Bureau is responsible; providing legal coverage on behalf of BOL when the Bureau Director is unavailable; work with program managers and surveyors to develop litigation strategies; maintain filing system, tracker system, and deadline system.
