Minimum Qualifications Eligible for transfer or reachable on the appropriate Civil Service eligible list.

Provisional: Eligible for a provisional appointment if candidate has one year of permanent service as a Human Resources Specialist 1.

A permanent non-competitive appointment may be made pursuant to Section 52 (7) of Civil Service Law, if three or fewer qualified candidates in the Department promotion field apply for this position. Qualifications for non-competitive promotion for this title include: One year of permanent service as an HR Specialist 1, G-18 or Senior Personnel Administrator, G-18.

Duties Description Under the general direction of a Human Resources Specialist 3 Labor Relations, the incumbent may supervise a staff of HR Specialist 1’s responsible for providing employee relations services to Department supervisors and managers or personally perform the following duties:
• Advises Department supervisors and managers on the appropriate means for handling employee performance or behavioral problems which impact the work situation. Interprets the terms of the negotiated agreements, department policies, attendance rules and Civil Service Law as they may apply to the situation. Conducts investigations using interviewing and interrogation techniques. Advice may include recommendations for counseling or discipline, additional training, a referral to the Employee Health Service for a fitness exam, a referral to the Employee Assistance Program, or other actions as appropriate.
• Prepares notices of discipline in accordance with the union contracts and serves as the State’s advocate throughout the disciplinary process. Participates and conducts agency level meetings. Acts as the state’s advocate or assists in the formal administrative hearings, including the development of evidence and the preparation of witnesses.
• Interacts with managers/supervisors and employees/employee organizations to resolve potential grievances. Mediates disputes and attempts to resolve problems at the lowest possible level. Advises first step reviewer on the appropriate response to a former grievance, as well as the contractual requirements. Conducts second step grievance meetings and writes agency level decisions. Assists GOER in obtaining information for third step review or grievance arbitration.
• Reviews performance evaluations and hears appeals of unsatisfactory ratings at the agency level. Provides advice and guidelines to managers, supervisors, union representatives, and employees about the performance evaluation process.
• Participates in the development and delivery of supervisory training as it relates to labor relations issues.
• Travel as required.
• Meet the Department’s time and attendance requirements.
