Bureau of Professional Medical Conduct (BPMC)
Minimum Qualifications Admission to the NYS bar and at least two years of post-bar legal experience.
Strong legal skills and excellent oral communication skills. The preferred candidate must be able to prepare lengthy, complex, detailed and well written legal documents, have demonstrated good decision-making ability, be able to work as a member of a team, and have the ability to handle a high-volume caseload in a deadline-driven environment.
Duties Description Reporting to the Deputy Counsel of BPMC’s Albany office, the candidate will serve as a staff attorney and will be responsible for prosecuting physicians, physician assistants and specialist assistants for professional misconduct. BPMC attorneys also assist the Department’s Office of Professional Medical Conduct with its investigations, as needed; negotiate Consent Agreements, Surrenders and other appropriate case dispositions with opposing counsel or the licensee; and represent the Department at administrative disciplinary hearings and in appeals to the Administrative Review Board. In addition, staff attorneys draft subpoenas for medical and other records; prepare responses for requests to modify or vacate Board orders; and assist in preparing documents, such as affidavits, for litigation brought in state or federal courts.
