Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.4 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree.)

Preferred Qualifications
The preferred candidate should be a highly motivated individual interested in working in public service as part of an active legal team with at least three years experience as a New York State Attorney. Preferred qualifications include strong research and writing skills, eager to learn new subject areas, demonstrated sound judgment, excellent oral communication skills.

Duties Description The New York State Department of Motor Vehicles is offering a unique opportunity to a Senior Attorney with strong interpersonal skills to act as the Agency’s Records Access Officer (RAO). The RAO is also responsible for managing the Freedom of Information Law (FOIL) and Subpoena Office, currently consisting of six non-attorney office staff/assistants. The RAO must ensure timely, legal responses to FOIL requests from the general public, the media, public employee unions, and other groups and individuals. The RAO must also respond to subpoenas and when appropriate, arrange for the production of documents and/or testimony. The RAO is responsible for compliance with the federal Driver’s Privacy Protection Act, the Public Officers Law, the CPL and CPLR, and applicable provisions of the Vehicle and Traffic Law, and is responsible for knowledge of the proper retention periods for various records. The successful candidate will research and advise the business units as to personal privacy laws applicable to projects and operations within the Agency and must work with all offices within the Department to obtain records responsive to requests. Prior managerial experience is a plus.
