Minimum Qualifications MINIMUM QUALIFICATIONS:

The right candidate will be admitted to practice law in New York State or have a law degree. Prior investigation experience, law enforcement experience or government operations experience preferred.

Duties Description STANDARD DUTIES:

The Director of Investigations is the head of the Investigation Section, responsible for the detection and prevention of fraudulent practices on the part of the unemployment insurance claimants, employers and Department employees. The Director will also have operational responsibility for worker protection initiatives that are carried out in conjunction with other state agencies and county based law enforcement agencies. To carry out this responsibility the incumbent:

1. Maintains general supervision over the assignment of cases for investigation.
a. Directs activities and investigations of all possible cases of fraud, willful misrepresentation, misdemeanors, felonies, and irregular practices received from a wide variety of sources.
b. Assigns investigators to spot-check employers in particular industries to determine whether fraud or misrepresentation has been committed either by the employer or his employees.
c. Reviews all important cases and the reports of completed investigations, takes appropriate action where indicated, and determines whether to forward them for prosecution.
d. Confers with District Attorneys to arrange for immediate arrest and indictment of benefit claimants in cases prosecuted as felonies.
e. Confers with other state agencies on joint enforcement initiatives to address worker exploitation
2. Directs the development of methods and procedures to prevent, detect and investigate fraudulent claims, collusion between employers and employees, cases of mass fraud, cases of wage theft, and other devices and conspiracies to violate the provisions of the Unemployment Insurance Law, Labor Law and Penal Laws, as well as other State and Federal Statues.
a. Develops techniques for the regular auditing of office records.
b. Develops methods to assist local operating units in preventing or detecting fraudulent claims and other violations of such laws.
c. Establishes and maintains liaison with all organizational components of the Department, so that suspected irregularities will be referred to the Investigation Section without delay.
d. Analyzes flagrant violation cases with a view to making recommendations for inclusion in the Benefit Payment and Tax Accounting Office.
3. Directs the holding of fact-finding hearings, examination of witnesses, and the scrutiny of all facts and circumstances arising from complaints of illegal practices or irregularities involving employees of the Department.
a. Personally conducts complex personnel investigations;
b. Assists in other legal and operational matters in the Division of Worker Protection, including but not limited to investigations of retaliation against workers who seek to enforce workplace rights under the New York State Labor Laws.
4. Initiates, conducts and supervises training programs for personnel in the Investigation Section on methods and techniques of investigation and fraud detection, and furnishes technical advice and assistance to Division heads, or their designated staff members on methods of detection and prevention of fraud and other improprieties and irregularities.
a. Participates in conferences conducted by Unemployment Insurance Division Director and/or area directors. Makes appropriate recommendations when additional controls are required.
b. Schedules on-going training conferences for Investigation Section personnel and acts as conference leader.
c. Lectures on advanced techniques for investigation at Federal Nationwide Training Programs.
