Minimum Qualifications This is a transfer opportunity open to all NYS employees with one year of permanent competitive service as an Associate Director Human Resources 3 (Labor Relations), M-3 OR in a title at M-2/SG-27 or above deemed administrative under Section 52.6 of the Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades or one M-grade.

Non-Competitive Promotion (NCP):
If there are no more than three qualified candidates in the direct line promotion field for this position, the agency may request approval from the Department of Civil Service to fill this position via a NCP examination, pursuant to Section 52.7 of the Civil Service Law. In order to be eligible for a NCP, candidates must be an employee of the Office of Information Technology Services and have had one year of permanent, competitive service in an Associate Director Human Resources 2 (Labor Relations), M-2 title.

Provisional:
There is currently no Civil Service eligible list for the Associate Director Human Resources 3 (Labor Relations), M-3 title. Therefore, candidates who meet the following Civil Service Minimum Qualifications may be eligible for provisional appointment:

One year of permanent competitive service as
Either A. as an Associate Director Human Resources 2 (Labor Relations), M-2 or Human Resources Specialist 3 (Labor Relations), M-1;

Or B. as an Associate Director Human Resources 2, M-2; Associate Director Human Resources 2 (Institution), M-2; Associate Director HR 1, M-1; Administrative Officer 2, M-1; Administrative Officer 3, M-2; or Director Human Resources 2, M-2.
NOTE: If you are appointed provisionally, you are responsible for taking the next Civil Service examination given for this title. In order to be permanently appointed to the item, you must pass the examination and be reachable for appointment on the resulting eligible list. If you do not take, pass and achieve a reachable score on the examination, you may not be retained in the position.

Preferred Qualifications:
Preferred candidates will have previous or current experience in Labor Relations, and demonstrate excellent communication skills, the ability to handle difficult situations and exercise sound judgment.

Duties Description Reporting to the Director of Human Resources Management, the Associate Director Human Resources 3 (Labor Relations) will plan, develop, and direct the labor relations program for the Office of Information Technology Services. ITS is comprised of approximately 3700 employees, in more than 150 locations, across 30 counties. Duties include, but are not limited to:

• Direct the administration of employee discipline and grievance procedures. Prepare and conduct interrogations; recommend action; draft and issue written communications and ensure consistent responses and practice.
• Participate in disciplinary arbitrations and other administrative hearings.
• Maintain rapport for effective labor-management activities with PS&T and CSEA. Direct labor-management committee meetings.
• Provide technical assistance and advice to agency management in implementing negotiated contracts and maintaining effective labor relations.
• Lead complex or sensitive cases/investigations.
• Represent ITS in Health & Safety and Workplace Violence Committees.
• Direct the fingerprinting and background check process; participate in the Criminal History Review Committee.
• Liaise with ITS Division of Legal Affairs and the Governor’s Office of Employee Relations to resolve complex or sensitive issues involving employee relations activity, including litigation involving disciplinary action or grievance determinations, and Equal Employment Opportunity Commission and Division of Human Rights complaints.
• Oversee the ITS Fingerprinting program, liaise with the New York State Police, and participate in the Criminal History Review Committee.
• Continually review and evaluate policies, procedures and negotiated agreements; advise on impact and provide recommendations as necessary.
• Participate in the development and implementation of the ITS HR strategic plan for continuous improvement initiatives.
• Develop and maintain employee relations metrics and provide routine related reports.
• Assess employee/manager training needs related to employee relations, collective bargaining, employee discipline, etc. Collaborate with Personnel and ITS Workforce Development to develop materials and implement.
• Assist the Director of Human Resources and Executive staff on projects or special assignments, as required.
• Perform the full range of supervisory responsibilities.
