Minimum Qualifications Legal Assistant/Legal Assistant Trainee:

Interested candidates must be reachable on the Legal Assistant 1 eligible list or Legal Assistant Trainee eligible list; or eligible to transfer under section 70.1 of the Civil Service Law.


To be eligible to transfer to Legal Assistant:


NYS employees must have at least one year of permanent competitive service in an appropriate SG-12 or higher title and possession of an associate's degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association, and meet transfer eligibility requirements.


To be eligible to transfer to Legal Assistant Trainee 1:


NYS employees must have at least one year of permanent competitive service in an appropriate SG-11 or higher title and possession of an associate's degree or certificate in legal studies, paralegal studies, or legal assistant studies from an accredited institution or one approved by the American Bar Association, and meet transfer eligibility requirements.

Trainees will be required to successfully complete six courses in paralegal studies and related skills from an accredited college or university. Also, in addition, one or more college or training courses in writing skills will be required in addition to on-the-job-training activities

Duties Description * Under the supervision of Retirement attorneys, prepare briefs that summarize case facts and apply relevant case and statutory law.

* Read hearing transcripts and identify key issues in hearing cases.

* Research relevant law by using books as well as Westlaw and other computer-based research tools.

* Draft legal briefs which include specific case facts, relevant law and analysis.

* Make recommendations to staff attorneys on next steps in processing cases.

* Perform these tasks with short notice when deadlines must be met.


* With general direction and supervision by an attorney and a Legal Assistant 2, handle all aspects of the investigation and recovery of overpaid retirement benefits. This involves drafting subpoenas, reviewing subpoenad documents, analyzing cases and referring cases to OSC Investigations or outside prosecuting agencies when appropriate.

- Review records in overpayment cases and prepare written memorandum summarizing the relevant facts and next steps for handling.

- Prepare draft letters to the OAG for referral of recovery cases.

- Track the processing of all civil recovery matters that are referred to Legal for review.


* Under the supervision of an attorney and a Legal Assistant 2, summarize, track and draft correspondence in bankruptcy, beneficiary designation, power of attorney, guardian, trusts, post retirement earnings cases, record requests, FOIL inquiries.

- Help to maintain our database which tracks the workflow of cases by

inputting information about incoming correspondence and how it was

handled.

- Examine incoming NYS power of attorneys, guardianship, trust and other legal documents to determine if they are valid, limited, or invalid for Retirement System purposes; draft memos and letters explaining the determination for each document and forward to the appropriate business unit to send out.

- Draft and send Chapter 7 Bankruptcy letters when initial proceeding notifications come in.

- Handle incoming record requests by tracking correspondence and payment for request records; ordering folders or using Filenet to print off copies of appropriate materials to send to the requesting party.

- Drafts response letters in miscellaneous cases at the request of staff

Attorneys.








* Miscellaneous clerical duties included, but not limited to phone coverage, preparing unit attendance list, mailings, photocopying and/or scanning documents, preparing subpoenas to serve on other entities, collecting Retirement System attorneys’ CLE information, and alternating meeting attendance with other support staff.

* Prepare and send mailings for attorneys, which may include preparing subpoenas to be sent to an out-of-agency process server.

* Cover phones for other support staff on the floor when needed.

* Collect, track, and maintain CLE credits earned by Retirement System attorneys.

* Attend meetings on various Retirement-related topics on an alternating basis with other Retirement support staff.


* Assist in the maintenance and coordination of appropriate hardware, network and database access through IT Security as the “backup” to the NYSLRS/Legal IT Security Coordinator.

* Work with IT Security to maintain appropriate hardware and software for new staff, using the appropriate forms and databases.

* Make requests for new or changes to existing hardware and software using the appropriate forms and databases.

* Request/provide the appropriate training for new hardware and software obtained for staff.

* Maintain and coordinate the issuance of new procedures and guidelines that may be implemented upon receipt of new software or databases.

* Coordinate with IT when any bureau network, software, hardware needs arise.

* Coordinate with the OSC Counsels’ IT Security Coordinator when there are any Legal Services division-wide changes are made that will affect ERS Legal Staff.

* Meet with IT Services and OSC Counsels’ IT Security Coordinator on a monthly basis to discuss any issues or outstanding work orders.

* Serve as Redesign (alternate) bureau representative with regard to training, testing and attending redesign change forum meetings.
