Duties Description POSITION DESCRIPTION:

The Office of Counsel provides legal guidance and services to the Office for People with Developmental Disabilities (OPWDD) service network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. This position will report to the Assistant Counsel for Medicaid, Contracts and Real Estate. The Bureau of Medicaid, Contracts and Real Estate provides legal support on a wide variety of issues related to Medicaid financing and Federal Medicaid Law, Benefits Eligibility, supplemental needs trusts, contracts and procurements, estates and trusts, and HIPAA/privacy protections, and is actively engaged in the Agency transition to Care Coordination Organizations and Managed Care.

PRIMARY DUTIES AND RESPONSIBILITIES:

As a Senior Attorney, the incumbent will perform the following duties:
• Assist and advise with respect to legal requirements regarding health information privacy;
• Review, draft and advise with respect agency policies regarding the handling of health information privacy and security;
• Advise with respect to potential privacy breaches;
• Assist and advise with respect to electronic health records and data sharing within managed environments;
• Assist in developing privacy agreements and business associate agreements with outside parties;
• Work with ITS to advise agency staff on sufficiency of data security measures;
• Advise and assist agency staff with respect to managed care implementation, including policy drafting, compliance, and program design;
• Assist and advise with respect to matters related to real property transactions and contract matters, with the sale and purchase of properties under OPWDD jurisdiction.
