Minimum Qualifications Open to NYS employees with one year of permanent competitive service as an Associate Director Human Resources 2 (Labor Relations) OR in a title at M-1/SG-25 or above deemed administrative under Section 52.6 of the Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades or one M-grade.

Preferred Qualifications: The ideal candidate will have excellent written and oral communication skills, strong technical understanding of all aspects of personnel administration, and an understanding of organization structures and management principles.

Duties Description The Associate Director Human Resources 2 (Labor Relations) will assist the Director to plan, develop, and direct the Employee Relations program for the Office of Information Technology Services (ITS). ITS is comprised of approximately 3,700 employees, in more than 150 locations, across 30 counties. Duties may include, but are not limited to:

• Implement collective bargaining agreements; represent the agency in both statewide and agency level negotiations; review and evaluate changes in negotiated agreements; and advise management of its impact on the employee relations program.
• Serve as a member of ITS’ Performance Evaluation Appeal Board, Workplace Violence Committee, Health and Safety, Labor-Management, and Continuity of Operations Management Committee.
• Provide expert advice and assistance to employees in the interpretation and administration of union contract provisions, agency policy and counseling/disciplinary matters.
• Oversee the administration of Employee Organizational Leave and Social Leave.
• Oversee the administration of employee discipline and grievance procedures. Prepare and conduct interrogations; recommend action; issue written communications and ensure consistent responses and practice.
• Participate in disciplinary arbitrations and other administrative hearings. In collaboration with ITS Division of Legal Affairs, conduct complex or sensitive hearings and investigations.
• In collaboration with ITS Division of Legal Affairs, prepare witnesses for both direct and cross examination at disciplinary arbitration hearings, and conduct both direct and cross examination of witnesses at disciplinary arbitration hearings.
• In collaboration with ITS Division of Legal Affairs, prepare and present opening statements outlining witness testimony, case evidence, and theory of the case at disciplinary arbitration hearings.
• In collaboration with ITS Division of Legal Affairs, deliver closing arguments summarizing major points of State’s case or draft written briefs summarizing main arguments and presenting persuasive discussion of management’s case at disciplinary arbitration hearings.
• Liaise with ITS Division of Legal Affairs and the Governor’s Office of Employee Relations to resolve complex or sensitive issues involving employee relations activity, including litigation involving disciplinary action or grievance determinations, and Equal Employment Opportunity Commission and Division of Human Rights complaints.
• Oversee the implementation of statutory leave provisions of Civil Service Law section 72, 72.5 and 73.
• Develop proposals for funding labor management projects from the various quality of work life committees and assist in their implementation. Submit purchases in SFS and reconcile statements.
• Oversee the administration of the ITS fingerprinting and background check process; participate in analysis of candidates pursuant to the Fair Chance Hiring guidelines from the Department of Civil Service and Article 23-A of the NYS Corrections Law.
• Review and evaluate policies and procedures; ensure alignment with ITS Work Rules; and recommend and implement revisions, as needed.
• Participate in the development and implementation of the ITS HR strategic plan for continuous improvement initiatives; maintain metrics and oversee related report-outs.
• Collaborate with ITS Personnel and Workforce Development units to develop and implement Employee Relations-related trainings.
• Assist Directors and Executives on projects or special assignments, as required.
• Perform the full range of supervisory responsibilities.

Additional Comments Travel is primarily within the capital district, with occasional daytime and/or overnight travel within the State as required. Approval to fill this position is pending.
