Minimum Qualifications This is a transfer opportunity open to all NYS employees with one year of permanent competitive service as an Associate Director Human Resources 3 (Labor Relations), M-3 OR in a title at M-2/SG-27 or above deemed administrative under Section 52.6 of the Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades or one M-grade.

Non-Competitive Promotion (NCP):
If there are no more than three qualified candidates in the direct line promotion field for this position, the agency may request approval from the Department of Civil Service to fill this position via a NCP examination, pursuant to Section 52.7 of the Civil Service Law. In order to be eligible for a NCP, candidates must be an employee of the Office of Information Technology Services and have had one year of permanent, competitive service in an Associate Director Human Resources 2 (Labor Relations), M-2 title.

Provisional:
There is currently no Civil Service eligible list for the Associate Director Human Resources 3 (Labor Relations), M-3 title. Therefore, candidates who meet the following Civil Service Minimum Qualifications may be eligible for provisional appointment:

One year of permanent competitive service as
Either A. as an Associate Director Human Resources 2 (Labor Relations), M-2 or Human Resources Specialist 3 (Labor Relations), M-1;

Or B. as an Associate Director Human Resources 2, M-2; Associate Director Human Resources 2 (Institution), M-2; Associate Director HR 1, M-1; Administrative Officer 2, M-1; Administrative Officer 3, M-2; or Director Human Resources 2, M-2.
NOTE: If you are appointed provisionally, you are responsible for taking the next Civil Service examination given for this title. In order to be permanently appointed to the item, you must pass the examination and be reachable for appointment on the resulting eligible list. If you do not take, pass and achieve a reachable score on the examination, you may not be retained in the position.

Preferred Qualifications:
Preferred candidates will have previous or current experience in Labor Relations, and demonstrate excellent communication skills, the ability to handle difficult situations and exercise sound judgment.

Duties Description The Associate Director Human Resources 3 (Labor Relations) will plan, develop, and direct the Employee Relations program for the Office of Information Technology Services. ITS is comprised of approximately 3,700 employees, in more than 150 locations, across 30 counties. Duties may include:

• Direct implementation of collective bargaining agreements; represent the agency in both statewide and agency level negotiations; review and evaluate changes in negotiated agreements; and advise management of their impact on the labor relations program.
• Co-Chair Labor-Management Committee. Maintain rapport for effective labor-management activities with PS&T and CSEA unions.
• Participate in Health & Safety and Workplace Violence Committees.
• Provide expert advice and assistance to employees in the interpretation and administration of contract provisions and counseling/disciplinary matters.
• Direct the administration of employee discipline and grievance procedures. Prepare and conduct interrogations; recommend action; issue written communications and ensure consistent responses and practice.
• Direct participation, in collaboration with the Division of Legal Affairs, in disciplinary arbitrations and other administrative hearings.
o Conduct complex or sensitive hearings and investigations. May assist the Governor’s Office of Employee Relations in presenting the State’s case at improper practice hearings before the Public Employment Relations Board.
• Prepare witnesses for both direct and cross examination at disciplinary arbitration hearings, conduct both direct and cross examination of witnesses at disciplinary arbitration hearings.
• prepare and present opening statement outlining witness testimony, case evidence, and theory of the case.
• Deliver closing argument summarizing major points of State’s case or draft written brief summarizing main arguments and presenting persuasive discussion of management’s case.
• Liaise with ITS Division of Legal Affairs and the Governor’s Office of Employee Relations to resolve complex or sensitive issues involving employee relations activity, including litigation involving disciplinary action or grievance determinations, and Equal Employment Opportunity Commission and Division of Human Rights complaints.
• Direct implementation of statutory leave provisions of Civil Service Law section 72, 72.5 and 73
• Develop proposals for funding labor management projects from the various quality of work life committees and assist in their implementation. Submit purchases in SFS and reconcile statements.
• Direct administration of the ITS fingerprinting and background check process; participate in reviews of candidate pursuant to Fair Chance Hiring guidelines by the Department of Civil Service and Article 23-A of the Corrections law. Prepare and provide quarterly Fair Chance Hiring report.
• Develop and evaluate policies and procedures, ensuring alignment with ITS Work Rules, and recommend and implement revisions, as needed.
• Participate in development and implementation of the ITS HR strategic plan for continuous improvement initiatives.
• Develop and maintain employee relations metrics, routinely analyze data and implement recommendations resulting from analysis.
• Assess agency Employee Relations-related training needs. Collaborate with Personnel and Workforce Development units to develop materials and implement.
• Assist the Director of Human Resources and Executive staff on projects or special assignments, as required.
• Perform the full range of supervisory responsibilities.
