Duties Description The incumbent of this position will be assigned tasks as the Records Access Officer. Duties will include but not be limited to:

• Insures that the Department complies with the Freedom of Information Law (FOIL) pursuant to Public Officers Law, Article 6, the Personal Privacy Protection Law, (PPPL) pursuant to Public Officers Law, Article 6-A, Section 15 of the State Finance Law, the Department’s FOIL regulations (17 NYCRR Part 1) and the Rules and Regulation of the Committee on Open Government (21 NYCRR Part 1401). Follows Department MAP 2.7-1, Processing Requests for Access to Department Records.
• Is familiar with legal precedent involving FOIL, opinions of the Committee on Open Government and must independently apply such precedents to all FOIL requests for the Main Office as well as insuring that such precedents are followed by all Regional FOIL officers.
• Manage the daily operations of the Records Access Office, interface with the public as well as NYSDOT program staff regarding FOIL and PPPL requests, such that every request is processed in accordance with the law.
• Determines the appropriate Department office, program area or Region to process the request for records and compile the responsive documents. Reviews each request for sensitivity and coordinates within the Department to advise the proper level of management accordingly.
• Maintains a database of all requests for Department records and monitors for timely response to such requests.
• Upon receipt of the records from the Department office, program area or the Region, reviews frequently large volumes of records, and determines if the records can be disclosed. Identifies provisions of FOIL that authorize the Department to properly withhold records under FOIL and applies PPPL and other laws and regulations to identify records that must be withheld from disclosure. Determines if redaction is necessary and makes all appropriate redactions prior to release of documents.
• Advises requester as to the availability of such documents, the basis for withholding or redacting any documents and the costs associated with receiving available documents.
• Arranges for the transmittal of such records upon receipt of any necessary payment. Handles correspondence with requestors of documents.
• Maintains a record of all moneys received and transmits such funds to the Accounting Bureau.
• Certifies records of the Department.
• Coordinates with all Regional Records Access Officers and provides guidance and training as to the application of FOIL and PPPL procedures and assists the Regions and the New York Metropolitan Planning Council in responding to requests for records. Provides monthly training sessions for Regional Records Access Officers.
• Coordinates with the Claims Unit in identifying FOIL requests concerning matters, litigation or claims involving the State.
• Responsible for compliance with the FOIL statutory deadlines regarding Department responses.
• Files an annual report with the Committee on Open Government.
• Assembles documents in response to subpoenas and other document or record requests as assigned by the Division of Legal Affairs.
• Prepares weekly status reports regarding outstanding FOIL requests as well as monthly and annual reports of state-wide FOIL statistics.
