Minimum Qualifications Employees who possess the following minimum qualifications may apply:

For a permanent appointment:

1. Employees currently holding permanent competitive appointment (or a permanent competitive appointment under Section 4.11) as an Associate Attorney OR
2. Employees who are eligible via 52.6 transfer to this title. OR
3. Applicants who are reachable on the current NYS eligible list for the Associate Attorney.

Duties Description Duties include but are not limited to:

1. Provides legal advice to HESC’s Executive Staff, managers, and administrators on issues that pertain to and have a significant impact on HESC’s mission and student financial aid programs, including proposed changes to existing programs and recommendations and advice for new programs to be administered by HESC.
2. Assists the General Counsel, serves as legal advisor to program administrators and managers regarding grant and scholarship programs administered by HESC.
3. Analyzes legal opinions, briefs, and other pertinent materials related to HESC’s mission and its administration of student financial aid programs.
4. Negotiates, drafts, and approves contracts and agreements with third parties, working with the Office of State Comptroller and the Office of Attorney General, when necessary.
5. Supervises Sr Attorney and/or other legal professionals, which includes reviewing and approving work products, assisting in the preparation for administrative hearings, providing training as necessary, etc.
6. Analyzes legal issues and searches and interprets statutes, decisions, laws, opinions, briefs, and other pertinent materials for use in reviewing legislation, regulations, contracts, and agreements relating to various HESC programs.
7. Prepares and presents HESC’s position at administrative and other legal proceedings, Board meetings and agency presentations, working with the Office of the Attorney General, when necessary.
8. Serves as Secretary to the HESC Board of Directors, which includes assisting the President in preparing for Board meetings, preparing minutes of meetings, making presentations to the Board, etc.
9. Discusses proposed and new legislation with agency personnel, legislators, and legal staff; advises them concerning legislation that affects agency programs and prepares drafts of proposed legislation to provide a comprehensive legislative program on behalf of HESC.
10. Drafts regulations necessary to effectuate new legislation and/or to clarify or modify existing legislation and/or regulations.
11. Works with Chamber staff on legislative, regulatory, and/or policy matters.
12. Monitors, tracks, evaluates, and provides advice on legislative and regulatory matters, which includes evaluating bills and legislation, preparing supporting memoranda, etc.
13. Recommends changes to rules, regulations, and/or policy statements to take into account new legislation, court decisions and requests for changes.
14. Provides legal advice and opinions to agency staff, complainants, and others about HESC’s activities, programs and services.
15. Prepares legal actions to enforce laws, rules, regulations, etc.
16. Discusses and negotiates with attorneys about claims, complaints, lawsuits, contracts, and other legal matters.
17. Performs other duties as assigned.

Additional Comments NOTE: This position requires working until 5:00 p.m. The position may require schedule modifications and additional hours to meet business needs and operational requirements. This position is not overtime eligible.
